REGAN Secretary LINDA CULPEPPER Interior Director DWR #18-0990 Franklin County On July 16, 2018, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification and Riparian Buffer Authorization from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. fhe.application is on -hold until the following information is received: 1. Page 10 of 11 of the ePCN depicts the signature of Julie Davidson. An agent. authorization was submitted to DWR; however, the agent authorization form depicts the signature of Julie Davidson as well. The application package requires an agent authorization letter signed by the applicant. A sample agent authorization letter can be found on the USACE website. Please correct agent authorization and e-mail to Stephanie Goss at stephanie.goss@ncdenr.gov [15A NCAC 02H .0502(f)] 2. The stream .and riparian buffer impacts requested in this application need to be clearly shown and enumerated on the site plan. These impacts need to correspond to the impacts requested in the application.' The labels on the site plan must match the .impacts listed in the application. As the application and impact map currently stands, it is not possible to match up what isilisted the application with the site plan. Please provide a copy of the locally approved stormwater management plan with proof of approval. [15A NCAC 02H .0506(b)(5) and (c)(5)] 4. A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has verified all stream, wetland, and/or open water locations for the project. [15A NCAC 02H .0502(a)(7)] 5. Please confirm the Corps of Engineers has verified the Nationwide Permit that is to be used to authorize this project. Please notify this office with the specific type of Nationwide permit that will be used by the USACE to permit this activity [15A NCAC 02H .0502(a)(7)] Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B .0259 (8), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity.
