Please review this draft carefully to ensure your understanding of permit limits and monitoring conditions, and to correct errors, if any. Concurrent with this notification, the Division will solicit public comment on this draft by publishing a notice in newspapers having circulation in the general Iredell County area, as required by the NPDES program. Please email your written comments, if any, to [joe.corporon@ncdenr.gov], or write to my attention at DENR / DWR / NPDES no later than October 19, 2018, approximately 30 days after receiving this document. We welcome your written comments, but they are not mandatory. The Division has considered your Engineering Alternatives Analysis (EAA) submitted with your application to renew. The EAA presents present -value costs and rationale for discharges to a publicly owned treatment works (POTW), land -based disposal, surface irrigation, reuse, and discharge to surface -waters of the State. DWR concurs that a discharge to surface waters is the best viable disposal alternative based on cost. Changes to the Permit Draft and Previous Permit — 1. Based on discussions (DWR/CWS) during the pre -draft review (June 22, 2018), DWR may reopen this permit to incorporate new data, as warranted [see Special Condition A. (3)]. Condition A. (3.) details schedules for permit limits and compliance deadlines as: a. compliance to metals limits begins on -or -before the expiration date of this permit. b. compliance to Total Chloride limits begins on -or -before September 30, 2021. DWR discontinued monitoring for Total Iron [no standard]; no longer of concern. 4. Lastly, we have updated your facility description, Supplement to Permit Cover Sheet. We added Total Hardness monitoring required to calculate future compliance for metals in dissolved fraction. Division records show that you have successfully registered with the eDMR Program. Beginning on the effective date of this permit, the Permittee shall submit monthly Discharge Monitoring Reports (DMRs) electronically using the Division's eDMR application system [see Condition A. (3)]. Until the state's eDMR application is approved compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), DMR hardcopy must be submitted as backup to eDMR reporting. 2. Effluent Flow shall be measured concurrently with samples for analysis, as may be practicable. Discharge event flow rate and flow duration shall be recorded in a log book, available for DWR inspection. 3. TRC limit and monitoring apply only if chlorine or chlorine derivatives are used to disinfect. The Division shall consider compliant all effluent TRC values reported below 50 µg/L. However, the Permittee shall continue to record and submit all values reported by North -Carolina certified test methods (including field certified), even if these values fall below 50 µg/L. 4. Turbidity shall not fall below 25 ntu [lake discharge]. If natural instream turbidity exceeds 25 ntu, this effluent shall not cause to increase natural turbidity conditions. Downstream sampling may be required to verify compliance. 5. Compliance to the Total Chlorides limit shall begin on -or -before September 30, 2021 [see Permit Reopener A. (3.)]; 6. Compliance to this permit limit shall begin on or before the expiration date of this permit. 7. Whole Effluent Toxicity (WET) Testing, Chronic, at 90% effluent concentration, 7-day pass/fail using the species Ceriodaphnia dubia, during the months of March, June, September, and December. Conditions: All samples shall accurately represent the chemical and/or physical character of the discharge. The Permittee shall discharge no floating solids or foam visible in other than trace amounts. Page 3 of 7 Permit NCO086606 A. (2.) CHRONIC TOXICITY PASS/FAIL - MONITORING (QUARTERLY) [15A NCAC 02B .0200 et seq.] The permittee shall conductg_uarterlX chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 90 %. The testing shall be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the months of March, June, September, and December. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. Duplicate signed copies shall be submitted to the mailing address above. See "How to Request a Waiver from Electronic Reporting" section below. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective.
