(Wildlands) is requesting written verification from the U.S. Army Corps of Engineers (USACE) regarding the extent of potential waters of the United States within the subject project area. The Bethel Branch Site is located northwest of the intersection of Moon Lindley Road and R. E. Wright Road northwest of the Town of Pittsborro in northwestern Chatham County, NC (Figures 1 and 2). The Bethel Branch Site is in the planning and design phase for the development of a stream and wetland mitigation bank. To date, a draft mitigation plan is being developed and Wildlands is currently in the process of finalizing easement boundaries. Methodology On December 13 and 14, 2016 Wildlands delineated potential waters of the United States within the proposed project easement area. These areas were delineated using the USACE Routine On-Site Determination Method. This method is defined by the 1987 Corps of Engineers Wetlands Delineation Manual and subsequent Eastern Mountain and Piedmont Regional Supplement. Wetland Determination Data Forms representative of on-site wetland areas as well as upland areas have been enclosed. Stream channels were classified according to USACE and NCDWR guidance. NCDWR Stream Classification Forms representative of on-site stream channels are enclosed. On November 21, 2017 a site visit was conducted with the USACE to assess the delineated features within the subject project area. Based on this sited visit, some changes were made to the initial submittal. Wetlands D, K, and L were removed due to the absence of all three hydrological indicators within these areas. Based on field assessment of on-site streams, all delineated streams were classified as non-wetland waters. Potential Waters of the United States The results of the on-site field investigation indicate that there are three non-wetland waters within the proposed project area which include unnamed tributaries to South Fork Cane Creek, hereafter referred to as UT1, UT2, and UT3. Nine wetland areas and one open water feature were identified within the proposed project area and are located within the floodplains (Figure 3). The project drains to South Fork Cane Creek (NCDWR Index No. 16-28-5) which is classified as Class WS-V, Nutrient Sensitive Waters (NSW) waters. Approximate linear footage and acreage of on-site waters are summarized in Table 1. Table 1. The scores on the NCDWR Stream Classification Form ranged from 19.25 to 35 out of 61.5 possible points. Throughout the majority of the project area, the stream channels and riparian corridors have been affected by active livestock grazing and hoof shear. As a result, degraded channel beds and banks as well as riparian communities are persistent along these reaches. Wetlands There are nine wetlands located within the project area and one open water feature. The wetlands occur in the side slopes and floodplains that drain to the on-site stream channels. These features exhibited a high water table, pockets of shallow inundation, saturation within the upper 12 inches of the soil profile, and a low chroma matrix. The open water feature is an impoundment at the headwaters of UTUT3The majority of these areas experience significant impacts from livestock grazing. Wetland Determination Data Forms representative of the wetlands and the associated upland points are enclosed. Table 1 shows the acreage of on-site wetland areas. Soils Soil types within the study area include Cid-Lignum complex (CmB) and Nanford-Badin complex (NaC). Cid- Lignum complex soils are moderately well drained to somewhat poorly drained and are prevalent throughout the project area. Nanford-Badin complex soils which are found along the right floodplain slopes along UT1 and are well drained. On-site soils are mapped in Figure 4. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) I am requesting that the Corps provide a preliminary JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be “waters of the United States” or “navigable waters of the United States”on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional “waters of the United States”. PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is “preliminary” in the sense that an approved JD can be requested at any time. PJDs do not expire. I am requesting that the Corps provide an approved JD for the property identified herein. An Approved Jurisdictional Determination (AJD) is a determination that jurisdictional “waters of the United States” or “navigable waters of the United States” are either present or absent on a site. An approved JD identifies the limits of waters on a site determined to be jurisdictional under the Clean Water Act and/or Rivers and Harbors Act. Approved JDs are sufficient as the basis for permit decisions. AJDs are appealable (33 C.F.R. 331.2). The results of the AJD will be posted on the Corps website. A landowner, permit applicant, or other “affected party” (33 C.F.R. 331.2) who receives an AJD may rely upon the AJD for five years (subject to certain limited exceptions explained in Regulatory Guidance Letter 05- 02). The Corps of Engineers believes that there may be jurisdictional waters of the United States on the subject site, and the permit applicant or other affected party who requested this preliminary JD is hereby advised of his or her option to request and obtain an approved jurisdictional determination (JD) for that site. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring “pre-construction notification” (PCN), or requests verification for a non-reporting NWP or other general permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is hereby made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which does not make an official determination of jurisdictional waters; (2) that the applicant has the option to request an approved JD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an approved JD could possibly result in less compensatory mitigation being required or different special conditions; (3) that the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) that the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) that undertaking any activity in reliance upon the subject permit authorization without requesting an approved JD constitutes the applicant’s acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is practicable; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a preliminary JD constitutes agreement that all wetlands and other water bodies on the site affected in any way by that activity are jurisdictional waters of the United States, and precludes any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an approved JD or a preliminary JD, that JD will be processed as soon as is practicable. Further, an approved JD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary to make an official determination whether CWA jurisdiction exists over a site, or 3 to provide an official delineation of jurisdictional waters on the site, the Corps will provide an approved JD to accomplish that result, as soon as is practicable.
