This review has shown the City of Lexington to be in violation of the requirements found in the WQCS00042 collection system permit and/or North Carolina General Statute 143.215.1(a)(1). The Division of Water Resources (DWR or Division) bases decisions concerning enforcement actions for SSOs on volume spilled, volume reaching surface waters, duration, gravity, impacts to public health, fish kills, and other factors. DWR may pursue enforcement action for these and/or any additional violations of the WQCS00042 collection system permit.
