The Cherokee Nation (CN) is in receipt of your correspondence about R-5735, US 19-74-64-129
Improvements, and appreciates the opportunity to provide comment upon this project.
The CN maintains databases and records of cultural, historic, and pre-historic resources in this
area. Our Historic Preservation Office reviewed this project, cross referenced the project's legal
description against our information, and found instances where this project intersects or adjoins
such resources. This project is within close proximity to culturally sensitive sites along the
Hiawassee Lake and Fart Butler, a Trail of Tears removal blockade. The CN has a vital interest
in protecting its historic and ancestral cultural resources. However, the CN does not object to this
project as long as the following stipulations are observed:
� The proposed Area of Potential Effect (APE) is within the current footprint of existing
roads. The CN requests that the North Carolina Department of Transportation (NCDOT)
maximize buffers to avoid direct and indirect construction impacts to Fort Butler and along
the Hiawassee Lake;
� The CN requests that NCDOT re-contact our Offices if there are changes to the scope of
ar activities within the APE;
• The CN requests that NCDOT halt all project activities immediately and re-contact our
Ofiices for further consultation if items of cultural signiiicance are discovered during the
course of this project.
• The CN requests that NCDOT conduct appropriate inquiries with other pertinent Tribal
and Histaric Preservation Offices regarding historic and prehistoric resources not included
in the CN databases or records.
