From my understanding, Richard Broughton (Martin Marietta) is planning to contact me or James to discuss options for transferring the permit to relieve Lane of ongoing responsibility while process -related materials are removed. I believe we can send refusal to them and let them pick other options. I reached out to Martin Marietta first to confirm the status of the property moving forward. As I mentioned during our phone conversation, one the three scenarios will need to be completed to close out the permit: 1) Removal of process -related materials from the site and stabilization of soils disturbed during removal of the plant; or, 2) Action from Blythe to include this area in the permitted area covered under their own NCG16 permit; or, 3) This area being included in the Martin Marietta Mining Act / NPDES permitted area. From follow-up correspondence with Richard Broughton, it appears that Martin Marietta will not be pulling this area back into their permitted area. Let me know when actions at the site have been completed and I will conduct a follow-up inspection. Additionally, disturbed soils were present in the area where the plant was demolished. The stockpiled materials represent process -related materials and present a potential for sediment discharge. From my understanding, this area will not be pulled back into the Mining Act / NCG02 permitted areas, nor will it be associated with the NCG16 permit of your other tenant. Since one of the primary intents of the NCG16 permit is to monitoring and reduce sediment discharge (via TSS monitoring), I've recommended to Raleigh that Lane's permit not be rescinded until the above listed materials are removed from the parcel. Additionally, I would like to see at least moderate stabilization of the disturbed soils at the former Plant site. From speaking with Tom, it sounds as if there is already an existing plan to move the RAP and sand to Blythe's area and Tom also indicated that the current lease agreement may require Lane to stabilize the disturbed soils. I will plan to do a follow-up inspection once I receive notification that the above actions have occurred. I would like to mention that although I'm not willing to support the permit being rescinded, I did not find any violations or other compliance -related issues during my inspection for either Lane Construction or Martin Marietta. The primary issue is that Lane will need to continue complying with the terms of the permit until the permit is rescinded. Please let me know if I've misunderstood any of the above stated information, particularly that the area is not being pulled back into the permitted mine area. If the area will be pulled back into your permitted area, that changes my opinion of the rescission since the potential sediment discharges will be accounted for by other permits. I'll plan to reach out to Greg Davis with Lane Construction after I hear back from you. Thank you again for accommodating my visit to your property.
