Interim Director September 12, 2018 Mr. Jimmy Ray Whitley 4187 US Hwy 70 East Smithfield, NC 27577 Subject: General Permit No. NCG020000 Whitley Borrow Pit COC No. NCG020931 Johnston County Dear Mr. Whitley: In accordance with your application for a discharge permit received on May 21, 2018, we are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except upon approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land Resources may require modification or revocation and reissuance of the certificate of coverage. Consideration must be given to the fact that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part IV, Section D of your permit. If, at any time, pumping activities occur onsite, you must obtain a Division approved Pumping Operation and Monitoring (POM) Plan. Pumping mine dewatering wastewater without Plan approval will be subject to enforcement action. Contact Thad Valentine at the Raleigh Regional Office at (919) 791-4220 for assistance with your POM Plan. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. Please be aware that there is a Total Maximum Daily Load (TMDL) in effect for this watershed. Information about this TMDL can be found on Division of Water Resources' website: hitps://deg.nc.gov/about/divisions/water-resources/plwmin modeling-assessmentttmdls. In Part I, Section A, the General Permit explains that for discharges to watersheds affected by a TMDL, coverage under this permit may depend on the site demonstrating that discharges have no reasonable potential to violate applicable water quality standards for specified pollutants. Salisbury Street 11612 Mail Service Center I Raleigh, North Carolina 2 769 9-1612 9197079200 Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage to stream buffers, from portions of this site that have been constructed after July 22, 1997, must meet diffuse flow requirements per 15A NCAC 2B .0233. Diffuse flow requirements are described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: bitp://deg.nc.gov/abouttdivisions/energy- mineral-land-resources/enerey-mineral-land-oermit-guidance/stormwater-bmo-manual. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources, the Coastal Area Management Act, or any other federal or local government permit that may be required.
