In reference to the above subject project the owner would like to construct a 16'x20'
room and adjacent walk onto their home as shown on the attached plot plan. The owner
feels they have vested rights as it relates to the current Neuse Buffer Requirements. The
owner has made substantial expenditures in good faith on their residential property and
subsequent upkeep. Their subdivision, Section One Club Terrace (recorded in PB 21 Page
221) was recorded in 1990, prior to the adoption of the Neuse Buffer rules. The owners
purchased the property in 1994, prior to the adoption of the Neuse Buffer Rules as evident
in attached deed. There exist a detriment in the ability to enjoy their property at its fullest;
due to the fact that since the property was purchased it has become encumbered by a
Neuse Buffer. Therefore, we would like to build the proposed structure and adjacent walk
in the Neuse Buffer (Zone 2) without complying with the new rules because of our vested
rights. Additionally, it appears that the buffered ditch is eroding part of the bank on the
subject property. Lastly, our lot seems to be one of the more "shallower" lots adjacent to
the buffer in the subdivision.

is hereby made to said map for a more particular description. This being a
portion of the property conveyed to Raven Ridge Developers, Inc. by dead of J.
C. Newcombe and wife recorded in Book 1387, Page 48, Wilson County Registry.
See also dead dated January 20, 1994 by Raven Ridge Developers, Inc. at al to
James A. Hicks recorded in Book 1514, Page 382, Wilson County Registry.
TO HAVE AND TO HOLD, the said lot or parcel of land and all privileges
and appurtenances thereto belonging to the Grantees.
BUT, NEVERTHELESS, expressly subject to those Restrictive Covenants
recorded in Book 1402, Page 530, Wilson County Registry and those easements
and permits of record.
And the Grantors covenant with the Grantees, that the Grantors are
seized of the premises in fee simple, have the right to convey the same in fee
