There is a remnant man-made canal located in the center of the property that has silted in over the years forming a vegetated plug between the Sound and the canal, isolating an area that has transition into a 3,444sf pocket of freshwater wetlands. Vegetation within the wetland area includes, but is not limited to, common reed (Phragmites australis), sawgrass (Cladium jamaicense), salt meadow hay (Spartina patens), seaside goldenrod (Solidago sempervirens), and pennywort (Hydrocotyle spp.). High ground vegetation includes loblolly pine (Pinus taeda), live oak (Quercus virginiana), sweetgum (Liquidambar styracijlua), and a variety of domestic grasses and weeds. The applicant has approximately 196' feet of shoreline that forms a small basin. The basin along the north and south side has a distinct erosion escarpment, while the center of the shoreline within the old canal alignment has a sandy beach that transition into a stand of common reed. Submerged aquatic vegetation has been documented within the small basin and is shown on the enclosed site plan. Water depths along the applicant's property are shallow, averaging approximately 2' at a distance of 100' offshore. Approximately 45' of the applicant's northern shoreline has riprap extending from the return wall of the bulkhead located on the adjacent property. A few feet of riprap has also been placed at the southern corner of the applicant's property extending from a neighboring bulkhead. The property has a flat profile with an elevation approximately 2' above normal water level, and is located in two flood zones. Measuring from Egret Lane it appears that approximately 300' feet of the property is located in an AE Flood Zone, and the remaining 263' is located in a VE Zone. Based on this information the Currituck County Flood Regulations must be applied when developing the property. Egret Lane is located in a rural residential setting. The applicant's property is vacant, with the exception of a small storage building, while the property to the north is developed with a variety of out buildings, _ a boatlift and a bulkhead. The property to the south is vacant with the exception of a bulkhead and boatlift. A CAMA Major Permit was issued to the adjacent property owners, Robert Ladd to dredge the canal located on his property. Properties located to the west of the property in question are vacant woodlands. The Currituck Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for the Albemarle Sound is SC (fish propagation). Review indicates that there are no identified archeological sites on the applicant's property; however, the shoreline along the Currituck Mainland has numerous documented archeological sites. PROJECT SUMMARY: The applicant, Michael Murray, proposes to construct a 252.Sft long bulkhead an average of 18.5 ft waterward of NWL, and fi113,444sf of isolated freshwater wetland. Michael Murray November 10, 2006 Page 3 The applicant would like to construct a 252.5 linear foot bulkhead along his shoreline and fill a 3,444sf area of freshwater wetlands within a remnant canal. The bulkhead would be constructed an average or 18.5', and a maximum of 34.5', waterward of normal water level. According to the application, there has been an average of 2' of shoreline loss within the last year. It is estimated that 150sf of known submerged aquatic vegetation (Widgeon Grass) habitat would be filled if the bulkhead is constructed within the requested alignment. The proposed bulkhead would be constructed to tie into the return walls of the existing bulkheads to the north and south. The property formerly had a canal which extended into the property which has been plugged naturally by sand from successive storm events. The applicant no longer desires to have or maintain the canal at -its original length. The portion of the canal separated by the sand- plug has reverted to an approximately 3-foot deep, 404 wetland, created through the deposition of silt and organic matter in the landward end of the former canal. The applicant proposes to fill the 3-foot deep 404 wetland area, and place another foot of fill on top (making a total of 4 foot depth of fill) to bring the area up to an acceptable elevation, and make it even with the rest of the property. The shoreline of the subject property is consistently subjected to wind-driven wave action and subsequent erosion. By connecting the proposed structure to the existing bulkheads on each adjoining property, there will be one continuous line of protection for the applicants' property. The purpose of the proposed bulkhead is to enhance the property and reduce the high rate of property damage caused by erosion. The applicant proposes to construct a 252.5 LF wood bulkhead connected to existing shoreline stabilization structures (bulkheads) on either side. In addition, 404 wetland fill will be placed in the area of the remnant canal discussed above. Some upland fill will also be needed to complete the project and make the site stable and usable. The impact areas include the 404 wetland area, the shoreline, some sound bottom behind the bulkhead, and the adjacent upland areas. Work will be completed using dump trucks for hauling fill and afront-end loader to distribute the fill and to grade the filled areas. The applicant and contractor shall confirm that the proposed structures meet or exceed the COUNTY BUILDING CODE at time of construction.
