Sullins Director Resources Dee Freeman Secretary May 18, 2009 CERTIFIED MAIL 47007 3020 0001 8861 0845 PCS Phosphate Attn: Jeffrey Furness 1530 NC Highway 306 South Aurora, NC 27806 Subject Property: Hell Swamp Mitigation REQUEST FOR MORE INFORMATION Dear Mr. Furness: DWQ Project # 08-1317 Beaufort County On May 27, 2009, the Division of Water Quality (DWQ) received your application dated March 26, 2009 to impact 18.82 acres of wetlands, 26,409 linear feet of stream and tributaries, and 1.04 acres of Zonel and 0.92 acres of Zone 2 riparian buffers for the purpose of wetland, stream, and riparian buffer restoration. The DWQ has received correspondence from the US Army Corps of Engineers (USACE) that they are discussing potential modifications to your project with the Division of Coastal Management. It is our understanding that the USACE is establishing a meeting to discuss potential modifications to your project. The DWQ will need to review any modification or additional information that may result from your meeting with the USACE. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 15A NCAC 2B .0259 (8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Modified PCN Please provide information or PCN modifications that resulted from your meeting with the USACE. Please respond in writing to the DWQ within four weeks of the date of this letter with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
