Ms. Magee
On September 5, 2018, the Division of Water Resources (Division) received your application dated August 19, 2018,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
The applicant proposes a 200 foot boulder wall with a rip rap skirt. Please provide a detail for the wall in
accordance with Duke Energy Shoreline Management Guidelines. https://www.duke-
energy.com// /media/pdfs/community/lakes-and-rec/lakeshoremgmt-guide-final-81903.pdf
2. After reviewing the submitted application, some of the pictures indicate shoreline stability and lack of
erosion. Please redesign the project to stabilize areas that have active eroding banks greater than 3 feet in
height. You can also submit additional photographs or schedule a site visit for me to review the project.
The application states that small vegetation and saplings will be removed. Please indicate the number of trees
greater than 3 inch Diameter at Breast Height (DBH) that are proposed to be removed.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 days, the Division
will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication
to the Division for approval, including a complete application package and the appropriate fee.
