Dear Mr. Tucker:
On December 23, 2008, the Division of Water Quality (DWQ) received your application dated
December 18, 2008, and Public Notice issued by the USACE on January 16, 2009, and received
by the DWQ on January 16, 2009, with additional information received from you on January 21,
2009, March 10, 2009, April 3, 2009, April 27, 2009, and May 12, 2009, to fill or otherwise
impact 2.05 acres of 404/wetland and 80 linear feet of perennial stream, to construct the
proposed Sunset Harbor Planned Unit Development (PUD) at the site. The DWQ has
determined that your application remains incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. The DWQ will

information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be
formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. On March 10, 2009, the DWQ received correspondence from Eric Galamb, NCDENR
Stewardship Director, requesting the DWQ place the above-referenced project "On Hold"
until the land swap issue referenced in his correspondences dated January 9, 2009, and
March 9, 2009 (also sent to Cape Fear Engineering, Inc.) is resolved.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of
this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh,
NC 27604-2260. If you will not be able to provide the requested information within that
