Dunn, Coastal Coordinator a Habitat Conservation Division DATE: August 7, 2018 SUBJECT: CAMA Dredge/Fill Permit Application for Donald Warren, William Chapman, William Rawls, and Charles Scanlon, New Hanover County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 6418 Providence Point, adjacent to Howe Cree near Wilmington, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicants propose to construct a new shared docking facility that consists of three 5' wide access piers that meet at a fixed platform measuring 12' by 16'_ From the fixed platform, a 5' by 325' long pier would extend to a fixed 8' by 16' "L -head" that leading to a lower step-down platform with a davit lift in water depths of 0' at NLW. On the northern edge of the fixed step down would be a kayak lift and on the southeastern edge would be a PWC lift. The kayak and PWC areas have water depths of -0.67' to -1' NLW. Howe Creek at this location is classified SA-ORW by the Environmental Management Commission and is designated a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. The waters of Howe Creek near the proposed project are a designated PNA. FNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats_ The NCWRC does not generally support boating activity and slips located within insufficient water depths due to a continued source of chronic sediment disruption and elevated turbidity associated with hull scraping, prop scour, and chronic bottom disturbance. The davit lift is located in the most -shallow area of the docking facility. This slip, as well as ingress and egress to the slip, would likely cause bottom disturbance. Therefore, we recommend the applicants consider removal of the davit or relocation to either the kayak or PWC area that exhibit greater water depths and are closer to deeper water within Howe Creek. We do recognize and appreciate the efforts the applicants demonstrated in the reduction of impacts to aquatic resources with the proposal of a shared docking facility.
