Project Summary: The applicants wish to construct a 29-slip residential marina, community clubhouse, and parking lot for private use and are applying for a permit to do so. Field Investigation Report: Fulshire Plantation Page 2 9. Narrative Description: The NC Division of Coastal Management staff has reviewed this proposal under the NC State Environmental Policy Act and issued a Finding of No Significant Impact on March 24, 2009. The property is located at the end of Waterway Drive (SR 1700) on Lot #1 of the Fulshire Plantation subdivision, off of Adams Creek Road in Craven County. The lot is a 5.59-acre tract adjacent to Adams Creek. This site is undeveloped at the terminus of Waterway Drive cul-de-sac. Some of the nearby adjacent waterfront lots in the subdivision are developed with residential dwellings, bulkheads, and docking facilities. The elevation of the high ground of the parcel is about +5' above the normal water level. Vegetation on this lot mainly consists of Coastal Wetlands, mixed trees and shrubs, and Section 404 Wetlands. This tract has approximately 846' of continuous shoreline along Adams Creek. Immediate offshore water depths adjacent to the lot range from about -0.2' to -4' nwl. The subaqueous substrate is firm with shell. This waterbody is about 3,200 feet across at this location. These waters are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This area is open to shellfish harvest and is classified as SA; High Quality, Nutrient Sensitive Waters. There is a defined Federal Channel approximately 2,000' offshore of the lot. 10. Proposed Development: The applicant wishes to construct a new 29-slip residential marina, clubhouse, and parking lot adjacent to Adams Creek near Harlowe. The proposed development will take place on the designated community lot (Lot #1) at the end of Waterway Drive of the Fulshire Plantation subdivision. The upland development consists of the construction of a driveway, parking lot, and community clubhouse. The access driveway will connect the Waterway Drive cul-se-sac to the proposed parking lot. This paved drive will be 300' long and 15' wide. The parking lot will also be paved in asphalt and will support ten vehicle parking spaces. This parking lot will be 110' long and 50' wide. The clubhouse will be 45' wide and 80' long. This upland development will be greater than 75' landward of the normal water level. The fixed access pier will leave from the southeast corner of the clubhouse in a southeasterly direction towards the shoreline. It will be 36" above the Coastal Wetland substrate. This section of the 6' wide pier will be 135' long. Here, there will be a set of stairs down to the shore. From there, the 6' wide pier will turn due south running parallel along the shoreline for a length of 295'. There will be another set of stairs accessing the beach at about the half-way mark. From here, the 6' pier will head 383' into Adams Creek in a northeasterly direction to connect to the 29-slip "L" platform. From there, the 6' wide "L" platform will head 250' in a southeasterly direction. The fixed platform will have 16 finger piers and 29 boat lifts to support the dockage of twenty-nine vessels. Each finger pier will run perpendicular to the "L" platform and will be 3' wide and 24' long. Each boat lift within the 29 slips will be 13' by 13'. These boat slips will be in -4'nwl. This residential marina will support vessels up to 24' long with no heads and no cabins. The marina will be 25' from the closest adjacent riparian corridor. 10. Anticipated Impacts: This docking facility will extend 475' waterward from in front of the clubhouse into the 3,200' wide waterbody. The new structure will be about 1,500' outside of the Federal Channel Setback and should not be a hazard to navigation. The 29-slip marina will usurp 101,120 ft2 of public trust waters and have 3,132 ft2 of platform area along 846' of shoreline adjacent to Adams Creek. The driveway, parking lot, and clubhouse will fill approximately 0.4 acre of high ground. The marina will shade 540 ft2 of Coastal Wetlands and 13,333 ftZ of open water. There is no submerged aquatic vegetation (SAV) in the project area. These waters of Adams Creek are classified as SA; HQW, NSW waters. These waters are not Primary Nursery Area and are open to the harvest of shellfish. The marina will have policies limiting the length of the vessels to a maximum length of 24' and will not allow vessels with heads nor cabins. Vessels of this small size coupled with water depths greater than -4'nwl, should eliminate the potential for "prop kicking" of benthic habitat. Doug Huggett THRU: Tere Barrett FROM: Brad Connell SUBJECT: Comments and Recommendations - CAMA Major Permit - Fulshire Plantation Marina, Craven County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the filling of 16,275 square feet of high ground. This proposal shades 540 square feet of Coastal Wetlands. The proposed residential marina incorporates 101,120 square feet of public trust waters. These waters of the Adams Creek are open to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal will not pose i hazard to navigation. This proposed residential marina appears to meet the specific use standards listed in 15A NCAC 07H .0208(b)(5). Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment for this project should be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit; 2) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the marina facility will require that the permittee undertake remedial actions to remedy the situation. C.....,i.., ,... __Eno! n__.1_1_A % no, n__• "" Fulshire Plantation Marina June 8, 2009 Page 2 of 3 4) Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program; 5) Prior to construction of any new boat slips or other docking facilities under this permit, the permittee must apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e); 6) This permit authorizes a maximum of 29 boat slips. At no time shall more than 29 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft; 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this public boating access facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 8) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge; 9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters; 10)Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.); 11)No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: This permit does not convey any rights, either in real estate or material. Vicinity Map PROJECT NARRATIVE (Supplement to form DCM MP-1) , Project: Fulshire Plantation Marina, Craven County Applicant: Coastal Marketing & Development Co Coastal Marketing and Development Co. proposes to construct a community marina that will offer a total of 29 permanent boat slips for vessels up to 24 ft in length with no heads and no cabins. The marina will also feature a 20 ft x 24 ft covered gazebo. An elevated boardwalk measuring approx 426 ft in length and 6 ft in width will provide access from the community clubhouse to the first fixed pier. The marina will be in close proximity to the AIWW, an active navigation channel. All proposed slips will feature a boat lift system to protect vessels from potential wave action. There is no excavation proposed for the 29 slip marina. All features of the marina will remain private use for residents and guests of Fulshire Plantation. Adams Creek in the vicinity of the proposed project is approved for shellfishing by the NC Division of Environmental Health. According to the standards set forth in 15A NCAC 18A.0911, "marinas with less than 30 slips, having no boats over 24 feet in length, no boats with heads and no boats with cabins" are allowable in shellfish growing waters. Therefore, vessels will be limited to a maximum of 24 ft in length with no heads and no cabins to further mitigate potential impacts to shellfish habitat. A handrail will be placed at the end of the furthest t-dock to prevent additional boats from docking at the marina. A community Dock Owner's Association will be created once a CAMA permit has been secured. Restrictive language concerning the vessel type and size will be included in the covenants of the DOA. The DOA will also be responsible for providing quarterly reports to the NC Division of Environmental Health which will detail the following; number of slips, number and lengths of boats, number and lengths of boats with cabins, number of boats with heads and number of boat with "porta-potties." Since only boats with no heads and no cabins will be allowable, there will be no pumpout facility provided. No additional marine services will be offered. Associated upland development includes a community clubhouse with a total of ten parking spaces. The total impervious surface coverage associated with the clubhouse structure and associated parking and road access to the marina is approximately 16,275 sq ft. The allowable built-upon area for the clubhouse site is 21,550 sq ft, as designated in the existing stormwater permit (Stormwater Permit No. SW7050605). A copy of the approved stormwater permit is included. There are presently no architecturally designed cross-sections for the clubhouse; however, the structure will meet all local building codes upon completion. All upland development will be located beyond the limits of the 50 ft Neuse Riparian Buffer set forth by the Environmental Management Commission (15A NCAC 26.0233) and the 75 ft Area of Environmental Concern set forth by the Coastal Resources Commission. The waters of Adams Creek and the AIWW in the vicinity of the proposed project are classified as Class SA; HQW; NSW by the Environmental Management Commission (EMC). This area is not a Primary Nursery Area (PNA) as designated by the NC Division of Marine Fisheries. The outer edge of the AIWW channel is approximately 2,100 linear ft from the project shoreline and approximately 1,390 linear ft from the outermost structures of the marina. Water depths within the proposed community marina are approximately -4 ft NWL. Craven County has no county-wide zoning ordinances. According to the Craven County Planning Department, the property is presently zoned as a subdivision within Township 5, The overall land plan for Fulshire Plantation was approved by the Craven County Planning Department and Craven County Commissioners on 1 August 2005. Water services will be provided by the Craven County Water Department. The on-site septic system was approved by the Craven County Health Department on 29 August 2005. A "Finding of No Significant Impact" was issued on 24 March 2009 for the proposed project. The Environmental Assessment completed the SEPA process in May 2009.
