Hi Mr. Shillington,
I reviewed the NOI application for Whitley Borrow Pit and there are a few things that need addressed before we can move
forward with coverage. On the NOI, you marked that the site would not have dewatering discharges. However, because
the rainwater will directly contact ongoing excavation activity, or where the process is taking place, the discharges being
routed out of the excavation area are considered process wastewater. Also, according to federal regulations for this mining
activity in 40 CFR 436, any pit overflow due only to rain or groundwater seepage is considered mine dewatering
wastewater. So, even though there won’t be dewatering in the form of pumping, the two outfalls on the site are subject to
effluent limitations outlined in Part IV, Section D of the General Permit.
We know this can be confusing for applicants. We have a guidance document (Mine Discharge Guidance) that further
breaks down and explains when mine discharges can be considered stormwater or wastewater—numbers 17 and 19 are
applicable to this site. With this information in mind, questions 24 through 38 of the NOI need reviewed and revised.
Please look through the guidance document and the aforementioned NOI questions, and let me know if you would like to
discuss further. Please submit the revised NOI pages (7-10) to me by August 20, 2018. Thank you.
