The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No Exposure
Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal and signed
certification of no exposure at the above referenced facility as well as observations made by Brandon Wise
with the Winston-Salem Regional Office on August 27, 2018, the Division is not granting your conditional
exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in
North Carolina regulations.
Please note the following reasons for denial of the application:
- Containment pallets exposed to elements with no covered area to store them.
- General housekeeping around solvent tanks is not in good condition and lends itself to impacts of the
stormwater on site.
- Appears to be buckets used to catch leaking solvent or transfer solvent from tanks in the area with
the solvents, exposed to the elements.
A no exposure permit can be obtained if these conditions are fixed, until then the site is expected to continue
monitoring and maintenance based on the NPDES permit NCG050142. If you have any questions or need
