Dear Mr. Parker: On May 22, 2018, North Carolina Division of Water Resources (NCDWR) conducted an onsite deterinination to review drainage features described in Table 1 regarding applicability to mitigation requirem�nts. Representatives froin the United States Ariny Corps of Engineers (USACE) and Ecosystem Planning and Restoration were present for the site visit. NCDWR aclrnowledges the areas and botu�claries identified as jtu-isdictiona] wetlands by tl�e USACE. The attaclied map(s) accurately depicts stream deterrninations conducted during t11e site visit. This on-site detennination shall expire five (5) years from the date of this letter. Landowners or affected p�rties that dispute a deteinlination made by NCDWR or Del�gated Local Authority that a sw-face water exists ai�d that it is slibject to the mitigation rules may r�quest a detelnii��arion by the Director. Ii�dividuals that dispute a determination by NCDWR or Delegated Local Authority that "exempts" a s�u•face water fi-om the mitigation rllles may ask for an adj�ldicatory hearing. You may obtain the petition form fi-om the office of AdminisU•ative hearings. You must file the petition with the office of Administrative Hearings withiil sixty (60) days of receipt of this notice and the date the affected party (including downstream ai�d adjacent landowners) is notified of this decision. A petition is considered filed when it is received in the office of Administrative Hearings during normal office hours. The Office of Adminisri-ative Hearin�s accepts filings Monday thro�igh Friday between the hours of 8:OOain and �:OOpm, except for official state holidays. The ori�inal and one (1) co�y of the petition must be filed with the Office of Adminish-ative Hearings.
