The request indicates that since placement of the roadway fill for the R- 2514D project, drainage problems have occurred on the adjacent landowners' properties and that to resolve the drainage problems, ditches are proposed for construction along the -L- line from Sta. 302+50 to Sta. 316+20. Additionally, downstream of the 48" RCP crossline at Sta. 303+00, an existing 24" driveway pipe would be replaced with a 54" pipe to further resolve the drainage issues. The request also indicates that the additional work would result in 9 linear feet of temporary stream impact, 127 linear feet of permanent stream impact, 16 linear feet of stream bank stabilization, 0.01 acres of permanent surface water impacts, and 8,785 sq. ft. of impacts within the Neuse River Riparian Buffer Zones on the project in Jones County. No additional impacts to wetlands are anticipated according to the request. The request includes a letter from the N.C. Division of Mitigation Services (DMS) dated July 11, 2018 assuming responsibility for satisfying the compensatory mitigation requirements for the additional stream and buffer impacts. The N.C. Division of Water Resources issued a Modification to the 401 Water Quality Certification for the additional impacts on September 5, 2018 (DWR Project No. 20141169 v. 9, WQC No. 004012). As you are aware, the R-2514 project is located within three counties, Onslow, Jones and Craven counties. The CAMA Major Permit No. 43-15 authorized impacts to Areas of Environmental Concern at the crossing of the White Oak River, and it also conveyed a Federal Consistency Determination for the remaining areas of the project. In accordance with provisions of Federal Consistency under 15 CFR § 930.46, Supplemental Coordination for Proposed Activities, the preparation of a supplemental consistency determination is required only if the proposed activity will affect any coastal use or resource substantially different than originally described. The current request for authorization to impact additional stream and buffer areas on the D-section of the project would effect areas located only within Jones County, which is not one of the designated coastal counties of North Carolina. Based on the review of the proposed changes as described above, and review of the original Federal Consistency Determination within CAMA Permit No. 43-15, DCM has concluded that the preparation of a supplemental consistency certification will not be necessary, and the project with the proposed changes is still consistent with North Carolina's Coastal Management Program. Should the project be further modified or revised, NCDOT should consult with DCM to determine if a permit modification or a Supplemental Consistency Certification pursuant to 15 CFR 930.66 is necessary.
