I am working on the application for Tanglewood Sand mine. I think we discussed this site briefly before, but I have been
on other priority projects during the summer and have not been able to get back to it. I wanted to touch base about
what the discharges are considered for this operation and about completing the alternatives analysis section of the NOI.
Discharges from the above ground stockpiles during the removal operation are from an active mine excavation area and
are therefore considered wastewater— not stormwater as the application notes the outfalls. Water will be drained from
within a bermed area, and federal regulations treat this drainage as a "dewatering" discharge. Also, the NCG02
guidance on our website addresses this type of discharge on page 2, item #19.
The only difference this makes is that the discharges will be subject to the monitoring and limits in Part IV, Section
D. Because of the federal definition and wastewater designation, NC rules require the applicant to complete the
questions on the NOI beginning with #32 and also the alternatives analysis in question #38 (multi -part). Those pages
are attached. The answers do not need to be extensive, as it is likely not difficult to demonstrate direct discharge is the
most practical as opposed to non -discharge alternatives here; however, these parts of the application must be
addressed. The rules in 15A NCAC 2H .0105 require an evaluation of alternatives for proposed wastewater discharges.
Please provide these completed sections by September 25, 2018, or let me know if you need additional time.
