The Division of Water Quality (DWQ) has performed a preliminary review of a 401 Water Quality
Certification application and performed a site visit. As the on-site visit triggered a Notice of Violation (NOV-
2009-SP-0014), and the NOV response covers the deficiencies in the application, we will be unable to further
process your application until a response for the NOV is received (that response is due by July 7, 2009).
Unless we receive the additional information requested in the NOV, we will have to move toward denial of
your application as required by 15A NCAC 2H .0507 and will place this project on hold as incomplete until
we receive this additional information.
This letter only addresses the preliminary application review and does not authorize any impacts to wetlands,
waters or protected buffers.
