Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:* Impacts Al, A2 & A3 are proposed wetland impacts for road fill & lot fill. These impact are necessary because the existing grade within the drained pond bottom is approximately 402 and the proposed road grade is average 417. A 3:1 roadway slope from the proposed right-of-way extends approximately 45 ft., this slope encompasses a majority of the 'lot fill'. The road is required for access to the property and the required elevation of the road is set by the existing Smallwood Drive. Impact B is proposed wetland impacts for lot fill. This impact was necessary to create buildable lots. Impact C1, C2 & C3 is proposed wetland impacts for road fill and the velocity dissipater, and lot fill. These impact are necessary because the road is necessary for access to the northeastern portion of the property. The road crossing location was determined to avoid impacts to the streams and riparian buffer, and also to avoid impacts to the 2018 Floodplain mapped by McAdams Engineering (required by Durham). Proposed road grade of 390 is necessary for drainage. The existing grade of 376 results in 14 ft of fill. At a 3:1 slope from the right-of-way, this slope encompasses the 'lot fill'. Retaining walls were utilized to minimize wetland impacts on the north side. The proposed wetland fill beyond the retaining wall is necessary to tie the grade back into the existing grade and the culvert. Impact D is a proposed pedestrian crossing with a wooden pedestrian bridge. This impact is necessary to access the active open space (i.e. dog park) on the north side of the stream and wetland. This crossing location was determined to avoid wetland impacts, stream impacts have been avoided by utilizing a bridge. This pedestrian crossing was also designed on an old pond dam, therefore requiring additional riparian buffer width. Impact E1 is a proposed impact to wetlands for sanitary sewer. The impacts have been minimized by shifting to the south as much as pacticable. Compensatory mitigation is proposed at a 1:1 ratio for permanent, no permanent loss impacts. Impact E2 is proposed impacts to Zone 2 of the riparian buffer for sanitary sewer. This impact is necessary to keep the longitudinal slope of the sewer easement for maintenance purposes. Impact F is proposed impacts to wetlands for sanitary sewer. This impact is necessary to connect to an existing manhole and has been minimized by shifting to the far western property boundary, and crossing at the narrow section of the wetland. Compensatory mitigation is proposed at a 1:1 ratio for permanent, no permanent loss impacts. All streams have been avoided on this project. The wetland impacts are drained pond beds. 1b. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Page Square project is a residential development. Additionally, the project is located within the City of Durham jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition to "diffuse flow" requirements and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements.
