Orphan Creek Bank Parcel Credit Release — Tasks 1,2 & 7
Dear Mr. Howard:
On January 22, 2018 the Division of Water Resources (DWR) approved a Bank Parcel Development
Package (BPDP) for the above -referenced site under the terms and conditions of the Restoration
Systems, LLC (RS) Haw -River Subwatershed Phase One Umbrella Mitigation Banking Instrument
for Riparian Buffer Mitigation and Nutrient Offsets (UMBI). On April 28, 2017, the DWR received a
recorded conservation easement and corresponding plat for the subject site. Additionally, RS
provided confirmation that the conservation easement for the subject bank has been successfully
assigned to The North Carolina Wildlife Habitat Foundation, Inc (NCWHF). NCWHF is a 501(c)(3)
non-profit corporation and has been approved by DWR as a long-term steward for this mitigation
bank.
On June 4, 2018, the Division of Water Resources (DWR) received an As -Built Report from RS
providing documentation that the subject site had been constructed in its entirety and monitoring
plots had been installed. On July 18, 2018, Ms. Merritt, with assistance from Raymond Holz with
RS, inspected the site and confirmed that all the subject site had been completely planted and
fenced, monitoring plots were all installed, stream restoration and enhancement activities
appeared to be completed, and all riparian areas, including the stream banks, were seeded and
stabilized.
In accordance with the UMBI and BPDP, signed on October 25, 2017 and approved on January 22,
2018 respectively, the following Project Milestones have been met and the corresponding credits
shall be released:

By copy of this correspondence, DWR confirms that the As -Built Report submitted on June 4, 2018
and the revised As -Built Survey received on August 3, 2018 are approved and the amount of credits
being issued with this letter reflect the totals provided in the As -Built Survey, which are slightly
different than what was approved in the BPDP.
RS has satisfied the above requirements for the above -referenced tract. Therefore, 45% of your
Jordan Lake riparian buffer Restoration credits (0.45 x 196,725.78 ft2 = 88,526.60 ft2) and 45% of
your Jordan Lake riparian buffer Enhancement credits (0.45 x 37,843.45 ft2 = 17,029.55 ft2) are now
released.
Additionally, 45% of your generated nitrogen (N) offset credits (0.45 x 494.86 = 222.69 lb -N) and
45% of your generated phosphorus (P) credits (0.45 x 31.64 = 14.24 lb -P) are now released.
Generated credits are credits that have not been applied to the appropriate delivery factor.
The delivery factors applied to this bank due to its location in the 14 -digit HUC 03030002050050 are
74% for nitrogen and 66% for phosphorous. Therefore, the total amounts of delivered nutrient offset
credits for this site are 366.20 lb -N and 20.88 lb -P. By copy of this correspondence, 45% of your
delivered nitrogen offset credits (0.45 x 366.201b -N = 164.79 lb -N) and 45% of your delivered
phosphorus credits (0.45 x 20.88 = 9.40 lb -P) are now available for sale.
Please note that only the delivered nutrient offset credits can be sold from this bank and used
for impacts in the Haw River Arm of Jordan Lake within the Cape Fear River Basin.
Additionally, riparian buffer credits can only be used to offset impacts located in the Haw
River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became
effective on November 1, 2015.
Please use the Credit Ledger Templates provided on our website at:
http://portal.ncdenr.org/web/wq/nutrientbuffertemplates to track and report credit availability for the
Orphan Creek Mitigation Bank. Upon receiving this correspondence, please submit four credit
ledgers to DWR reflecting the available credits released for each mitigation type.
