Dear Mr. Cole:
The Division of Water Resources (Division) has reviewed the submitted variance request received on
August 9,2018 for the subject project,with a revision request received on August 23,2018. The Division
will grant the variance requests for the installation of gravity sewer at a slope below the required
minimum as well as a manhole being located within 50-feet of a class WS-IV stream in accordance with
the provisions for alternative design under 15A NCAC 02T.0105(n):
1. Pursuant to the variance request received August 9,2018 from Davis-Martin-Powell&Associates
on behalf of the Town of Jamestown and NCDOT, a variance is granted for the construction and
operation of approximately 491 linear feet of relocated 20-inch ductile iron gravity sewer
(Line PS800) at a slope of 0.03% between manholes MH-21 and MH-17, and at a slope of 0.04%
between MH-17 and the existing manhole,as indicated on the provided plans and supplementary
documentation, and subject to the following requirements:
• a. The sections of gravity sewer described above shall be designated as"high-priority sewer"
in accordance with 15A NCAC 02T.0402.
b. High-priority sewers shall be inspected by the permittee or its representative at least once
every six-months in accordance with the Permittee's individual system-wide collection
system permit(WQCS00314).
2. Per the request for revision of this variance approval as received on August 23, 2018, an
alternative design is approved for MH-18, located within 50.linear feet of Bull Run Creek(a class
WS-IV stream) per the provided revised plans, and subject to the following requirements:
a. Manholes shall be provided with a watertight frame and cover with gasket.
b. Seams shall be externally taped/sealed.
c. Structures shall be provided with a full waterproof interior coating/lining.
d. Watertight pipe connections shall be provided consisting of a flexible watertight rubber
boot or compression type connector. -

e. Structures shall be tested in accordance with ASTM C1244.
f. All structures not included as part of a USACOE 404 Permit or Division 401 Certification
shall maintain a separation of no less than 10 feet from wetlands. 4
g. Testing results shall be provided with the project certification and record drawings.
Regardless of the variance approval, in the event that the wastewater collection facilities fail to perform
satisfactorily,including the creation of nuisance conditions,the Permittee shall take immediate corrective
action, including those as may be required by this Division, such as the construction of additional or
replacement facilities.
All other elements of this project shall be constructed in accordance with all applicable rules and statues
including, 15A NCAC 2T; the Division of Water Resources' (Division) Gravity Sewer Minimum Design
Criteria adopted February 12, 1996 as applicable;and the Division's Minimum Design Criteria for the Fast-
Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable. Approval of the
variance request does not constitute approval of the permit.
