Project Summary: The applicant wishes to expand an existing 10-slip docking facility into a 17-slip marina for community use and is applying for a permit to do so. Field Investigation Report: Trent River Villas Page 2 9. Narrative Description: This project was reviewed under the NC State Environmental Policy Act process and received a Finding of No Significant Impact on April 8, 2009. The property is located in New Bern at 123 Dylan Lane, Craven County. The parcel is a 3.37-acre tract adjacent to the Trent River. This site is developed with a condominium complex called Trent River Villas, a 10-slip docking facility, a bulkhead, and associated infrastructure. Immediately adjacent to the Trent River Villas condos along the southern property boundary, lies the NC highway 70 bypass bridge. Along the northern boundary, are some single family residential homes. The uplands on this site are developed with condominium buildings and associated infrastructure. This site has a 10-slip docking facility with three boatlifts, and a vinyl bulkhead to stabilize the shoreline. The average elevation of the high ground of the parcel is +7' above normal water level. Vegetation on this particular tract is mainly consists of lawn grasses. This tract has approximately 440' of continuous shoreline along the Trent River. Immediate offshore water depths adjacent to the tract range from -2.F to -13.4' nwl around the existing docking facility. The subaqueous substrate is firm without shell. This waterbody is approximately 2,060 feet across at this location. These waters are not classified as a Primary Nursery Area and there is submerged aquatic vegetation adjacent to the existing docking facility. This area is closed to shellfish harvest and is classified as SB; Sw, Nutrient Sensitive Waters. There is a defined navigation channel in the immediate vicinity of the project area, 120' from the terminus of the 10-slip docking facility. 10. Proposed Development: The applicant wishes to expand the existing 10-slip docking facility by adding seven new slips adjacent to the Trent River. The applicant is proposing the addition of four finger piers to support the creation of this 17-slip residential marina. The existing fixed docking facility has six finger piers and sixteen tie pilings on the south side of the 220' long access pier to support its ten boat slips. Slip #7, slip #8, and slip #9 each have a boat lift installed. The four proposed finger piers will be on the north side of the main access pier to support the seven additional slips. Each new fixed finger pier will be 3' wide and 24' long. There will also be twelve tie pilings included within these seven new slips. The marina will be 126' from the closest riparian corridor. This marina will be able to support vessels up to 28' long. 10. Anticipated Impacts: The seven new slips will usurp 5,166 additional square feet of public trust waters and shade 288 ft2 of open water in the Trent River. Currently, there is submerged aquatic vegetation (SAV) in the near vicinity of the dock in an area that is -2.4'nwl deep. There are no wetlands on site and there is no associated upland development proposed at this time. These waters of the Trent River are classified as SB; Sw, Nutrient Sensitive Waters. These waters are not Primary Nursery Area and are closed to the harvest of shellfish. This proposed development will not encroach into the defined channel in this area, nor be a hazard to navigation. This marina will have 720 square feet of platform area along 440 feet of shoreline. Turbidity impacts resulting from the piling installation will be minimal and short-lived. There will be no "prop-kicking" impacts due to the deeper water depths (greater than - 4'nwl) in the area of the proposed slips. Gregson, Director Dee Freeman, Secretary MEMORANDUM DATE: June 15, 2009 TO: Doug Huggett THRU: Tere Barrett FROM: Brad Connell v?( SUBJECT: Comments and Recommendations - CAMA Major Permit - Trent River Villas, Craven County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal usurps an additional 5,166 square feet of open water for the expansion of the docking facility, for a total of 20,274 square feet incorporated by the marina. This marina will have 720 square feet of platform area along 440 feet of shoreline. These waters of the Trent River are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. This proposed residential marina meets the specific use standards set forth in 15A NCAC 07H .0208. Assuming that state and federal agencies concur with the proposal, the Morehead City district staff recommend the project be authorized as proposed, contingent upon the following conditions: 1) No submerged aquatic vegetation will be excavated, filled, or otherwise disturbed; 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this public boating access facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 3) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge; 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-2808 \ FAX:- 252-247-3330 \ Internet: www.nccoastalmanagement.net An Equal Opportunity \ Affirmative Action Employer - 50% Recycled \ 10% Post Consumer Paper Trent River Villas June 15, 2009 Page 2 of 3 4) The marina will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier; 5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure; 6) The authorized structure and associated activity must not cause an unacceptable interference with navigation; 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party; 8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather; 9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters; 10)This permit authorizes a maximum of seventeen boat slips. At no time shall more than seventeen vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft; 11)Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment for this project should be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Boat owners will be required by our condo owners association rules to place dye packs into their heads with an association representative.to control illegal discharge. We propose to place 3 "No Sewage Discharge" signs at the beginning, middle, and end of the dock. (ii) Give the location and number of "Pumpout Available" signs proposed. Pumpout will not be permitted at this site and we will clearly state that in our terms with the boat owners per our homeowners agreement. f. Describe the special design, if applicable, for containing industrial type pollutants, such as paint, sandblasting waste and petroleum products. Per our homeowners agreement, no boat owner at this site will be permitted to provide repairs on this site. A repair facility which is located with a half mile down river allows owners to do so. We would make the suggestion for them to repair at that facility. g. Where will residue from vessel maintenance be disposed of?
