Subject: The replacement of Bridge No. 42 over Gale Creek on NC 304 in Pamlico County
T.I.P. B-5129E, DWQ project number 20090454
Dear Mr. Johnson:
The Division of Water Quality has reviewed your 401 Water Quality Certification submittal for the subject project.
Review of your application revealed it lacks information required for our staff to make an informed permit decision.
The permit application was deficient in the following areas:
Application not accurate. We understand that the impacts to jurisdictional resources have been reduced or
otherwise altered from what was listed in the original application in order to comply with CAMA regulations.
NC DWQ has not received any formal notification from DOT informing us of these changes.
Buffer Zones not shown. The southeast canal off Gale Creek is subject to the Tar-Pamlico Riparian Buffer
Rules (15A NCAC 2B .0259). No buffer zones and the subsequent impacts to them were depicted on the plan
sheet.
Please submit a revised PCN application and plan sheets that show these revisions.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we are placing the permit application on hold until we are
supplied the necessary information. You have 21 business days to respond in writing with the requested information
or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not
received this information in writing, we will assume you are withdrawing your application and it will be returned.
Until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the
US Army Corps of Engineers place the project's associated 404 permit application on hold.
