Credit Release- Task 3
Dear Mr. Hutton:

On June 21, 2018, the Division of Water Resources (DWR) received a final As -Built Report
from Wildlands Engineering, Inc. on behalf of Wildlands Holdings III, LLC (WEI) for the
subject site. On July 18, 2018, Katie Merritt with DWR, requested clarifications and edits to
the report. On July 24, 2018, DWR received a revised As -Built report with all the
recommended clarifications and edits. According to the As -Built survey submitted with the
As -Built Report, there are slight adjustments in the total amounts of Buffer Mitigation
credits and Nitrogen Nutrient Offset credits as compared to the Bank Parcel Development
Package. The subject site has generated 10.53 acres (458,663.8 ft2) of buffer restoration
credits, 398.07 ft2 of buffer preservation credits and 4.00 acres (9,092.08 lbs) of Nitrogen
nutrient offset credits. The credits being released have been modified to reflect any
changes to the creditable acreage as proposed in the BPDP.
DWR received a performance bond (#106807921) to cover performance obligations for the
construction of the subject site. This bond expires upon approval of the As -Built Report for
the subject site. By copy of this letter, the performance obligations to construct the subject
site have been met and DWR is releasing WEI from its financial assurance obligations with
regards to the performance bond (#106807921) with Travelers Casualty and Surety
Company of America.
DWR received a performance bond (#106888834) issued to WEI to cover monitoring and
maintenance at the subject site. The term of this bond applies from June 20, 2018 and ends
with the approval of the Year 1 Monitoring Report. Future credit releases will be
dependent on both the renewal of this performance bond and the annual monitoring
reports.

In accordance with the MBI, signed on February 28, 2018, the following Project Milestones
have been met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements
for the above -referenced tract and 10% of your Nitrogen nutrient offset credits
(0.10 x 9,092.08 lb -N = 909.211b -N) minus 30.68 lbs -N yields 878.53 lbs -N that are now
available for sale. Additionally, 10% of your Neuse buffer Restoration credits (0.10 x
458,663.80 ftz = 45,866.38 ft2) minus 5,302.89 ft2 yields 40,563.49 ft2 now available for sale.
Lastly, 10% of your Neuse buffer Preservation credits (0.10 x 435.60 ft2 = 39.81 ft2) minus
16.89 ftz yields 22.92 ft2 that are now available for sale.
Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to
15A NCAC 02B.0240. Additionally, the riparian buffer credits must be used for impacts
in the Neuse River Basin in accordance with guidelines in the Consolidated Buffer
Mitigation Rule, 15A NCAC 02B.0295, which became effective on November 1, 2015.
