On May 22, 2009, the Division of Water Quality (DWQ) received your application for a
Major Variance to the Tar-Pamlico Riparian Buffer Rules 15A NCAC 2B .0259.Your
application was dated May 21, 2009 and requested impacts to the Tar-Pamlico Riparian
Buffer on Ocracoke Island in Hyde County, for the purpose of shoreline protection and
marsh creation. Through discussions with your consultant the DWQ has determined that
the proposed impacts are "Allowable" within the Table of Uses in the Tar-Pamlico
Riparian Buffer Rules and your application for a Major Variance is not required. The
proposed impacts to the local resources can be addressed during the CAMA Major Permit
review for the application that you are currently submitting to the Division of Coastal
Management. The DWQ is therefore returning your application and no further
correspondence is required regarding this application.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Kyle Barnes
