Sullins Dee Freeman Governor Director Secretary June 16, 2009 DWQ# 09-0575 Guilford County CERTIFIED MAIL: 7008 3230 0000 9861 5972 RETURN RECEIPT REQUESTED Todd Preuniger Withers & Ravenel 111 MacKenan Dr Cary, NC 27511 Re: Section 401 Water Quality Certification application Dear Mr. Preuniger: On May 19, 2009, the North Carolina Division of Water Quality (Division) received your application for a 401 General Water Quality Certification to impact 367 linear feet of stream and 0.071 acres of wetlands for construction of the Lynwood Lakes Sewer and Water Improvements in Greensboro NC in Guilford County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H.0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506. Please provide the following information so that we may continue to review your project. 1. Please provide a detail showing restoration of temporary crossing areas. The detail should include clear instructions that indicate riprap is to be removed and/or reinstalled to below the water level. The Division prefers that natural matting material be used whenever appropriate. 2. Per Condition 19 of General Certification 3699, the temporary construction easement within wetlands or at stream crossings may only be 40 feet wide. The impact sheets submitted with the application indicate some temporary construction easement areas of up to 55 feet wide. Please revise the plans accordingly. 3. Per Condition 12 of General Certification 3699, the edge of the construction corridor may not be closer than 10 feet to a stream. The impact sheets submitted appear to indicate there are areas where the temporary construction corridor is beyond, or right adjacent to the top of the stream bank. Please review this information and adjust your design plans accordingly. If adjustment is impossible, please provide a construction sequence for working along the top of the stream bank that addresses sediment and erosion control measures as well as restoration of the area upon construction completion. 4. For areas of the sewer line that are parallel to the stream channel and within wetland areas, please indicate whether any sediment and erosion control measures will be placed outside of the temporary construction easement shown on the plans. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
