Dear Ms. Higgins,
On behalf of our client, LCD Acquisitions, LLC, Kimley-Horn is submitting the attached revised Pre -
Construction Notification (PCN) application package for the above referenced project to modify and
update the previously issued 401 Approval and Buffer Authorization to match the revised project footprint
per US Army Corps of Engineers (USACE) requirements.
Following the receipt of the USACE comments relating to avoidance and minimization efforts of the
previously proposed Thornberry Street extension, Kimley-Horn and LCD Acquisitions, LLC revisited the
requirement for the roadway extension to the property line with the City of Raleigh. Based on the USACE
feedback, our client was granted an exception from this requirement by City reviewers and the proposed
Thornberry Street extension has been removed. Due to this change, Kimley-Horn has revised the Site
Plan and associated plan sheets, Figure 6b, and the PCN application to reflect the removal of proposed
culvert associated with the Thornberry Street crossing. This change has removed all stream impacts
previously approved by at the NCDWR-designated impact sites S2 and B2. Impact site B3 has shifted
slightly to account for the site layout modification, and impacts associated with the drainage conveyance
have been further reduced. The realignment of the interior layout has added a small area of grading and
revegetation in Zone 2 only (650 square feet), which has been re -designated as buffer impact site 2 in the
attached revised PCN.

Land use within the project parcels consists of a cleared grass and gravel lot used for event parking during stadium and
NC State Fairground events. The northern portion of the project area is forested and crossed by a perennial stream. A
single family house is located in the middle of the project area, but the structure is abandoned. Land use in the vicinity of
the project is generally urbanized, and developed for industrial, commercial, and institutional uses. The developments in
the vicinity are interspersed with pockets of undeveloped forested land.

result of a perpendicular road crossing associated with the project. Site 1 is the primary entrance and exit road into the
property carrying traffic from Westchase Boulevard and Trinity Road, and also includes impacts associated with outlet

protection at the downstream end of the culvert. Riprap will be utilized for outlet protection and will be keyed into the bank
during installation so no permanent loss of waters will result from the outlet protection. Temporary impacts to S1 will also
occur due to temporary dewatering activities needed to facilitate construction access in the stream bed for the culvert
construction/installation. All temporary disturbance areas will be returned to pre -construction contours after completion of the
project.

6i. Comments: Unavoidable impacts to the protected riparian buffer associated with stream S1 (UT to Richlands Creek) will
result from the proposed construction of a main north -south connector road between Westchase Boulevard to the north and
Trinity Road to the south. This main north -south connector road will serve as the entrance and exit route into the development.
A small area of Zone 2 will be graded and revegated to assist with Site layout near the northern limit of the development south
of S1. The small area of grading and revegation will not compromise the vegetation in Zone 1 and will not concentrate
stormater flows. A third impact site will result from the construction of a stormwater management pond outfall in the
northeastern corner of the development. All riprap protection at Site 3 will stop at or before top of bank to prevent stream
impacts to S1.
D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Impacts to the streams and buffers within the project corridor were minimized to the extent practical. Stream impacts were
minimized by aligning the road crossing to be as close to perpendicular crossing over S1 as possible at the necessary
crossing location. Headwalls have also been utilized in the design to allow narrower fill slopes and minimize the culvert length
and impacts to S1. Stream S1 crosses the entire property along the northern boundary, preventing any access to Westchase
Boulevard without a stream impact. The stream crossing was selected to utilize a perpendicular crossing with minimal buffer
impact.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Impacts to streams and buffers within the corridor will be minimized to the extent practical throughout the construction process
by avoiding stream and buffer features whenever possible. Where feasible, staging and construction access routes will be
located in upland areas throughout the corridor. Silt fencing, sediment basins, and other Stormwater Control Measures
(SCMs) will be used throughout the construction process to minimize impacts to downstream receiving waters and minimize
runoff from the construction sites.

The NC Natural Heritage Program Element Occurrence Database (updated October 2017) indicates no known
occurrences any federally listed threatened or endangered species within 1.0 mile of the project area. Suitable habitat is
not present within the study area for Michaux's sumac due to the open field being used for parking and regularly
maintained through mowing, and field edges are overgrown with vine shrub species. Habitat is not present for red -
cockaded woodpecker due to the lack of mature pines and historic development within this area resulting in successional
forests. Suitable habitat is also not present for dwarf wedgemussel due to the low -flow, encised, and rocky nature of
stream S1.
Incidental take of Northern long-eared bat (NLEB) is prohibited if it occurs within a hibernaculum, or if it results from tree
removal activities within 0.25 mile of a known hibernaculum or the activity jeopardizes a known maternity roost tree or
trees within a 150 -foot radius of the maternity roost tree. Per the NC Natural Heritage Program Element Occurrence
Database (updated October 2017), there are no known occurrences of NLEB, hibernaculums, or roost trees within 1.0
mile of the project area.
Due to the lack of known occurrences within the study area and the lack of suitable habitat within the study area, the
proposed project is not anticipated to have any effect on any federally listed threatened or endangered species.

The North Carolina State Historic Preservation Office HPOWEB GIS Service (Accessed June 21, 2017) was reviewed
and no National Register sites or National Register Study List sites are present within the project area. A single structre
within the project area is listed in the database as "Survyed" in 1989, but is not listed on the NR or NR SL. The structure
in the project area is the Medlin House (WA0945), and a family cemetary is located along the eastern property boundary.
Due to the presence of the surveyed structure and the location within the central area of Raleigh resulting in over 40
known properties/sites within a 1.0 -mile radius of the project, Kimley-Horn conducted an Environmental Review with the
NCSHPO in advance of this permit application. Attached is the Kimley-Horn project review request outling the findings of
the historical properties investigation, as well as the concurrence letter from NCSHPO (dated August 22, 2017) confirming
that the proposed development will have No Effect on historic or archaeological sites.
