(SEGi) has been retained by Town & Country Developers at Wilmington to pursue approval to impact 0.33 acre of jurisdictional wetlands. The fill will be necessary to establish infrastructure associated with a 344-lot residential subdivision; to be located at 1389 Old Lennon Road in Bolivia, Lockwood Folly Township, Brunswick County, North Carolina. The property was owned by Avalon Land Development, LLC, from September 2005 until January 2006, when it was sold to Town & Country Developers at Wilmington. An ingress/egress easement was granted to Town & Country Developers at Wilmington by Avalon Land Development, which allows for access to home sites via NC Highway 211. Impacts to wetlands associated with the project consist of 0.32 acre of fill to allow construction of roadways and 0.01 acre of fill to complete the alleyway. In order to conform to minimum DOT standards, the existing access road from NC 211 will require widening, thus creating the need to impact one hundred thirty-five linear feet (135 LF) of stream. Wetlands on the lot cover 42.56 acres and are located throughout the property. Minimization and avoidance of impacts to 404 jurisdictional wetlands has been incorporated into the design plan. 2. All remaining on-site wetlands will be placed in preservation. The preservation offer has been broken down into open water preservation and wetland preservation. In correspondence with the Army Corps of Engineers, it was determined that the Applicant would be allowed modify the preservation document and incorporate the ability to use the 19.50 acre lake found on-site for passive recreational uses. The modification also allows for an access easement, to provide future residents with an area to launch their canoes and/or kayaks. 3. A 0.39 acre portion of forested wetland, associated with the unnamed tributary to the Lockwood Folly River, will be restored to its original wetland state. This will be accomplished by plugging a historic drainage ditch at the west end of the subject restoration area. 4. Applicant shall make payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in an attempt to off-set impacts associated with the stream crossing. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The areas surrounding the project site are mostly wooded and undeveloped, or in the process of being developed for residential subdivisions. 10. Describe the overall project in detail, including the type of equipment to be used: Applicant wishes to develop a 3441ot residential subdivision located at 1389 Old Lennon Road in Bolivia. Lockwood Folly Township, Brunswick County Proposed development plans include common areas. as well as active and passive open spaces for use by residents. Utility corridors, sewer areas, fire hydrants and roadways will be put into service to meet the needs of future residents Heav~quipment will be used in this project. such as back hoes and bull-dozers. The machinery will be used to clear the land. stabilize the soil and establish grade. Applicant has also been granted an ingress/egress easement through the adjacent property owned by Avalon Land Development, LLC, giving future residents access to their homes via NC-211 (please see attached documentation). 11. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The easement is strict in its limitations as to where the access road must be situated (see attached documentation) Please note• the access easement is proposed to impact the narrowest portion of the wetland complex site VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses. of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httn://h2o.enr.state.nc.us/ncwetlands/strmgide html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if off site), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. In an attempt to off-set the proposed stream impact, the Applicant is proposing to make payment to the North Carolina Ecosystem Enhancement Program at a 1.1 ratio In addition, the Applicant is~roposing to place all-remaining on site wetlands into Page 7 of 10 preservation, and also proposes to restore 0.39 acre of forested wetlands. Please see attached restoration plan and restrictive covenants for specifications. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. Determine if the "stub-outs," Culdees Lane (next to Paramount, formerly Avalon II) and Pennywort Court (adjacent to Lennon Hills), are strictly for connectivity between proposed subdivision, or if subdivisions will be sharing amenities. The "stub-outs" found within the proposed Avalon subdivision are strictly for interconnectivity between the subdivisions. Brunswick County Subdivision Ordinances require that, "Subcollector, local, and minor residential streets shall connect with surrounding streets where necessary to permit the convenient movement of traffic between residential neighborhoods or to facilitate access to neighborhoods by emergency services vehicles or for other sufficient reasons, but connections should not be permitted where the effect would be to encourage the use of such streets by through traffic."' With that said, it is not the Applicant's. intent to share amenities with neighboring subdivisions, or to encourage additional traffic to use interior streets, but to merely provide interconnectivity between the subdivisions and allow emergency service vehicles access without having to use main roads. 2. Determine whether or not a verification has taken place within the easement area. SEGi performed a wetland delineation on the tract of land found south of Avalon, where an access easement was granted to Town & Country by Avalon Land a SEG Development Company, LLC. At the present time, a jurisdictional determination package for that property has not been submitted to the Army Corps, though the site has been surveyed by Danford & Bristow. The un-verified wetlands that cross the easement, as well as the un-verified corner of a wetland complex found on Lots 274 and 275, are depicted on the preliminary plat. In addition, the Engineer placed a notation on the plat, stating that these two specific areas have not been verified. Finally, SEGi is submitting the appropriate data sheets and documentation for the un-verified portions of the property with this letter, for your reference. 3. Is the project considered high density or low density? Due to the fact that Avalon is not located within '/z mile of SA waters, the subdivision is allowed 30% impervious surfaces (after subtracting the area for the 100' wetlands buffer, lake and pond). If the site were located within '/z mile SA waters, it would be allowed 25% impervious surfaces. Also, the subdivision will be utilizing 1001inear feet of 5:1 grassed swales to treat the stormwater collected in the catch basins. - Total site = 8,767,358 sf (201.27 ac) - Area in lake and pond = 903,870 sf (20.75 ac) - Area in 100 ft wetlands buffer =190,205 sf (4.37 ac) - Paved roads, curb and gutter, and alleys = 716,694 sf (16.45 ac) - Sidewalks =114,183 sf (2.62 ac) - Future development (amenities) = 60,000 sf (1.38 ac) 8,767,358 - (903,870 + 190,205) = 7,673,283 sf (176.15 ac) ~ used for density 7,673,283 x 0.30 = 2,301,984.9 sf (52.85 ac) ~ the 0.30 represents the 30% allowable impervious surfaces 2,301,984.9 - (716,694 + 114,183 + 60,000) =1,410,837.9 sf (32.39 ac) ~ what remains after removing subdivision infrastructural impervious surfaces 1,410,837.9 / 344 = 4,101 sf/lot (.09 ac) ~ maximum impervious surface per lot 1,410,837.9 + 716,694 + 114,183 + 60,000 = 2,301,714.9 sf (52.84 ac) of impervious, which is equal to the 30% allowable impervious. SEGO 4. Demonstrate "limited access" for easement area, due to potential for additional construction. It is not possible for the Applicant to place limited access in this area, as he is not the owner of the parcel containing the easement. The Applicant was granted an easement solely for the purpose of allowing future residents ingression and egression to the proposed Avalon subdivision,. via NC-211. The Applicant has absolutely no control over the development of property that he does not own, and has no right to restrict the use of property that does not belong to him. 5. Provide zoom shots of lots with wetlands on them, to show that lot fill would not be required. Zoom shots of lots with wetlands on them have been provided along with this justification letter, to visually show that none of the fill requested is for lot fill, and also that no additional, after-the-fact impacts to wetlands would occur. 6. Break down preservation offer, so there are acreages of open water preservation and wetland preservation. The preservation offers were broken down into open water preservation and wetland preservation. In correspondence with the Army Corps of Engineers, it was determined that the Applicant would be allowed modify the preservation document and incorporate the ability to use the 19.50 acre lake found on-site for limited active recreational uses, such as kayaking or canoeing. Please see attached restrictive covenants for specifications. At this time, we respectfully request the Corp consider the aforementioned justifications pertaining to the proposed Avalon subdivision. November 2006 Introduction Town & Country Developers at Wilmington, Inc., (Town & Country) is proposing to develop a subdivision, Avalon, that will be located at 1389 Old Lennon Road SE, Bolivia, Lockwood Folly Township, Brunswick County, North Carolina. Town & Country is requesting Department of the Army approval for unavoidable impacts to section 404 wetlands. The developer has retained Southern Environmental Group, Inc. (SEGi) to prepare a mitigation plan to off-set all unavoidable wetland impacts associated with the proposed development. Avalon encompasses 201.27 acres. A wetland delineation was completed by SEGi on 27 May 2005. A jurisdictional determination was received from Mr. Thomas Farrell on 25 January 2006 (Figure 7-Tear Sheet). It was determined that of the 201.27 acres, 42.71 acres would be considered wetlands, according to the parameters set forth by the United States Army Corps of Engineers Wetlands Delineation Manual. Avalon was sold to Town & Country Developers at Wilmington, after the wetland delineation and subsequent verification took place. Of the 201.27 acres found on-site, Town & Country purchased 199.53 acres. Of those 199.53 acres, 42.56 acres are considered wetlands, according to the Corps' parameters described above. Historically (pre-project), the site has been used for agricultural and grazing purposes. At the present time, a variety of different habitats are present throughout the property. There is an unnamed tributary (UT) to the Lockwood Folly River that infiltrates the property from the west. A large, 19.50-acre freshwater lake exists as a result of an agricultural dam being placed across the UT. A pond was excavated in an upland area, where a previous owner unsuccessfully attempted to raise crayfish. Fields surround the lake area and wooded areas, including the wetlands. The forested areas of the property are primarily wetlands, with a small fringe of forested upland. The remainder of the site is farm land, which has been used as either spray fields for agricultural wastewater, or grazing for livestock. The property identification numbers (PIN) associated with the site are 16900011 and 1690001101. The surrounding land uses in the vicinity of the project are future residential development, silviculture and agriculture. Impacted Sites At the present time, 42.56 acres (1,853,913.6 square feet) of jurisdictional wetlands exist within the proposed development. Completion of the proposed subdivision requires that 0.33 acre (14,374.8 square feet) of 404 wetlands and 135 linear feet of stream be impacted. There are eleven (11) areas of proposed wetland impacts located throughout the proposed subdivision. Ten (10) of the proposed impacts are associated with the completion of roadways, which would grant property owners access to lots. The internal streets are to be private roadways, but will be constructed to meet County and DOT standards. One (1) impact is associated with the incorporation of a proposed alleyway, which maintains the Charleston-style, southern-charm inspired theme of the subdivision. One (1) stream impact of 135 linear feet is proposed. The applicant would like to replace an existing culvert (considered maintenance of an existing culvert), and enlarge the road crossing in the easement area to conform to DOT standards. Wetland fill is proposed only for portions of the roadway where no route through uplands is possible. The impacts are unavoidable, and have been minimized as much as possible (Figure 2- Impact Map). The areas of proposed wetland impacts can be classified as forested wetlands, channelized drainways/farm ditches, freshwater marsh and swamp forest. The swamp forest wetland complex, as well as the stream impact, are found on the site adjacent to the subject property. Town & Country was granted an easement through the adjacent property, owned by Avalon Land Development, LLC, to allow future Avalon residents ingress and egress from their property, via NC-211. The easement is strict in its limitations as to where the entranceway must be situated, therefore this impact is unavoidable. Soils Soil types present within the proposed Avalon Subdivision include Baymeade fine sand (Arenic Hapludults), Baymeade and Marvyn soils (Arenic Hapludults and Typic Hapludults), Foreston loamy fine sand (Aquic Paludults), Goldsboro fine sandy loam (Aquic Paludults), Kureb fine sand (Spodic Quartzipsamments), Lynchburg fine sandy loam (Aeric Paleaquults), Muckalee loam (Typic Fluvaquents), Murville mucky fine sand (Typic Haplaquods), Norfolk loamy fine sand (Typic Papudults), Onslow fine sandy loam (Spodic Papudults) and Torhunta mucky fine sandy loam (Typic Humaquepts) (Figure 10-Soils Map). The soil types mapped in the areas of proposed impacts include Baymeade fine sand (Arenic Hapludults), Baymeade and Marvyn soils (Arenic and Typic Hapludults) and Muckalee loam (Typic Fluvaquents). According to the National Hydric Soils List, Muckalee loam is classified as a hydric soil, while the latter two soils are not identified as such. Vegetation Vegetation associated with the project site includes: Acer rubrum (Red maple), Aralia spinosa (Devil's walking stick), Berchemia scandens (Supplejack), Callicarpa americana (American beautyberry), Carex spp. (Swamp grass), Cyrilla racemiflora (Beakrush), Liquidambar styraciflua (Sweetgum), Liriodendron tulipifera (Yellow poplar), Lyonia lucida (Fetterbush), Nyssa biflora (Swamp tupelo), Persea borbonia (Red bay), Pteridium aquilinum (Braken fern), Quercus virginiana (Live Oak), Rhynchospora spp. (Titi), Salix nigra (Black willow), Smilax rotundifolia (Greenbriar) and Vitis spp. (Grape spp.). The wetland types present within the project site, and vegetation found within each during site evaluation include: The forested wetlands are vegetated with a canopy of: Acer rubrum, Liquidambar straciflua and Nyssa sylvatica; and an understory of Carex spp. and Smilax rotundifolia. The channelized drainways/farm ditches found on-site are vegetated with a canopy of: Acer rubrum, Liquidambar styraciflua and Salix nigra; and an understory of Cyrilla racemiflora and Rhynchospora spp. • The freshwater marshes found on-site are vegetated with a canopy of: Salix nigra; and a shrub layer of Aralia spinosa. The swamp forest is vegetated with a canopy of: Acer rubrum, Liquidambar styraciflua and Quercus virginiana; and a shrub layer of Berchemia scandens, Lyonia lucida, Persea borbonia and Vitis spp. Hydrology The site is currently fed by precipitation combined with a high, shallow ground water table. The forested wetland on the western property boundary acts as a headwater region for the unnamed tributary to the Lockwood Folly River. Hydrology indicators in this area include: inundation, saturation within the upper 12", water marks and water-stained leaves. Mitigation The proposed wetland impacts will permanently impact 0.1644 acre of forested wetlands, 0.132 acre of channelized drainway/farm ditches, 0.008 acre of freshwater marsh and 0.026 acre of swamp forest. As compensation for these impacts, restoration of 0.39 acre of forested wetland is proposed, in addition to the preservation of 23.06 acres of wetlands. Use and restrictions associated with the 19.50 acres lake found on-site are addressed in the restrictive covenants for Avalon. Restoration (0.39 acres) The first component of wetland compensatory mitigation will be the restoration of forested wetland associated with the unnamed tributary to the Lockwood Folly River, totaling 0.39 acre (Figure 8-Exhibit Map, Figure 12-Restoration Area On-site Pictures). As denoted on the Wetland Mitigation Map, it appears that the area most conducive to wetland restoration is the north-west forested wetland area. The soil in this area is mapped as Baymeade fine sand, with a seasonal water table of five feet. There is a historic drainage ditch at the west end of the subject restoration area that carries water into the unnamed tributary. This ditch will be plugged to retain the water, which will hydrate the proposed restoration area. The mere influx of water should restore the wetland back to its original hydrologic regime. The proposed restoration area is already vegetated with a healthy over- and under-story, comprised of Acer rubrum, Liquidambar stryraciflua and Nyssa sylvatica; and an understory of Carex spp. and Smilax rotundifolia. If rehydrated, it appears the wetland restoration area will resume normal, healthy wetland functions. Please see attached planting list for specifications regarding vegetative species to be introduced to the wetland restoration area (Figure 11- Planting List). Preservation Areas (23.06 acres) The second area of proposed mitigation consists of the preservation of 23.06 acres of unaffected wetlands, located within the proposed Avalon subdivision (Figure 8-Wetland Mitigation Map). Recent urban impacts within and adjacent to the conservation sites increase the need for preserving wetland functions. Residential subdivisions that are either proposed, or in the construction phase, include: Paramount (Avalon Land Development, LLC), Lennon Hills (Lenhil, Inc.) and The Reserve at Palmetto Creek (Logan Homes). Preservation of this land will provide a significant vital resource protection in the Lumber River basin. In order to insure perpetual protection of the mitigation sites, Town & Country is proposing a permanent conservation easement be placed on the wetland preservation areas (23.06 acres). The easement will be designed to ensure perpetual preservation of the property and will be held by the respective homeowner association. In correspondence with the Army Corps of Engineers, it was determined that the Applicant would be allowed modify the preservation document and incorporate the ability to use the 19.50 acre lake found on-site for limited active recreational uses, such as kayaking or canning. Restrictions to the active recreation area include: no use of motorized or electric engine boats. Please see attached restrictive covenants for specifications regarding restrictions associated with the 19.50 acre lake found on-site (Figure X-Restrictive Covenants for Avalon). Habitat Values Due to the high quality of these wetlands, they provide a number of functions pertinent to wildlife, which migrate through the area seasonally or utilize these areas during a life history stage. These wetlands provide habitat in an area where development may eventually occupy the majority of the surrounding land. Mammalian species which may utilize the wetlands include: Odocoileus virginianus (white-tailed deer), Vulpes vulpes (red fox), Urocyon cinereoargenteus (gray fox), Procyon lotor (raccoon), Didelphis Virginiana (opossum), Sciurus carolinensis (gray squirrel), and smaller rodents such as the field mouse. Bird species which may utilize the wetlands include: various species of predatory hawks and owls, as well as smaller bird species such as Turdus migratorius (american robin), Cyanocitta cristata (blue jay), Mimus polyglottos (mocking bird), Cantopus virens (eastern wood pewee), Parus carolinensis (carolina chickadee), Thryothorus ludovicianus (carolina wren), Parus bicolor (tufted titmouse), species from the family Ardeidae (herons), among others. It should be noted that this habitat provides excellent migratory and resident song bird habitat and nesting areas. Herpetological species which may utilize the wetlands include: Agkistrodon piscivorus (eastern cottonmouth), Agkistrodon contortrix contortrix (southern copperhead), Nerodia erythrogaster erythrogaster (redbelly water snake), Opheodrys aestivus (rough green snake), Elaphe obsoleta obsoleta (black rat snake), among others. Turtle species likely to be found include: Terrapene Carolina (eastern box turtle), Clemmys guttata (spotted turtle), Chelydra serpentina (common snapping turtle), and Kinosternon subrubrum (eastern mud turtle). Many toad species from both the Scaphiopus (spadefoot) and Bufo (true toads) families, as well as frogs from the Hyla (tree frogs) and Rana (true frogs) families. Various species of salamanders from the Ambystoma (mole salamanders), Notophthalmus (newts), and Plethodon (wood salamanders) families. Monitoring and Success Criteria To ensure the successful establishment of the restored wetlands, long term monitoring will be required. The hydrologic regime will be monitored, for a five (5) year period, or until the Corps deems the restoration successful. Biannual site visits will be conducted in the spring and fall seasons, and yearly reports will be submitted in the spring. Photographs will be taken on-site, to document the viability of the restored wetland complex. The success criteria of this mitigation site will be based on the 1987 Army Corps of Engineers Wetlands Manual. The mitigation site will be deemed successful once it meets the three wetland parameters outlined in the manual. The site will be deemed successful by meeting the following success criteria for a period of five (5) consecutive years, or until the Corps' deems the restoration successful: Vegetation Vegetative success will be based on the dominance of FAC+, or wetter, species within the restoration area. Visual inspection and photographs of vegetation will be taken to document the vitality of the complex. Species diversity will be noted during the growing season. The presence of vegetation and hydric soil, in addition to the rehydration of the restoration area, should produce a dynamic wetland system. Again, please see attached planting list for specifications regarding vegetative species to be introduced to the wetland restoration area (Figure 11-Planting List). Hydrology Hydrologic monitoring within the site will consist of determining the position of the water table at various locations in the restoration area. Monitoring wells will be installed to a depth of 20 inches and will be sealed with sand and bentonite. These wells will take a daily reading of the water table depth and this data will be processed into graphs and plotted against National Weather Service rainfall data for the area. Success criteria of the hydrologic parameter requires the site to exhibit one or more of the primary indicators; or two or more of the secondary indicators of hydrology as outlined in the 1987 Army Corps of Engineers Wetlands Manual for fifty-one percent (51 %) of the growing season under normal conditions (e.g. normal rainfall, normal temperatures, etc.). In order to be considered a viable wetland complex, the plotted data from the monitoring well must document that the water table is within twelve (12) inches of the surface for five percent (5%) of the growing season. According to the Brunswick Count Survey, the growing season for Brunswick County occurs between March 7 and November 28. Five percent (5%) of two hundred sixty-five (265) days equals thirteen and forty-five hundredths (13.45) days'. Should the created wetland meet the aforementioned criteria, in addition to having viable wetland vegetation and hydric soils, the applicants could consider the created wetlands a success. Soils Hydric soils are present at the proposed restoration location and their hydric conditions will be enhanced as a result of restoring the sites' hydrology. This will be accomplished by plugging an old ditch and returning the restoration area to its original hydrologic regime. Establishment of a hydrologic regime, in addition to the presence of existing wetland vegetation and hydric soil should help ensure the success at the proposed restoration area. Contingency Plan Should the above-referenced restoration plan not meet the success standards and specifications set forth by the United States Army Corps of Engineers, the Applicant is proposing to make payment to the North Carolina Ecosystem Enhancement Program in an amount proportionate to compensate for impacts to jurisdictional waters.
