I agree, with a couple clarifications: There is no need to submit a renewal application for NCG12 unless directed to do so by the Division as per 15A NCAC O2H .0127(e). We do not plan to require any applications for General Permits expiring this year. Once a request is in-house for a modification to the Mayo Electric Plant permit to include the Monofill, the Division will consider the timing needed to complete the modification to the ISW permit. If the timing is such that it cannot be concluded before NCG12 expires, we will ensure that coverage under General Permit NCG12 will not lapse before the modified individual permit can be issued. One option to accomplish this beyond October 31, 2017 if needed would be to reissue a new NCG12 COC to Mayo Monofill for an abbreviated amount of time under the renewed General Permit, and then rescind that COC upon issuance of the individual permit that covers these discharges. DEMLR will have to determine the best course of action based on timing and staff resources. This process will require a major modification, which will mean a public notice period for the modified individual stormwater permit. There is a reasonable chance a public hearing will result, but that will not be determined until further into the process. If you have any other questions, please let us know. The Mayo Station would like to pursue a modification of its existing NPDES ISW permit to include the three monofill outfalls currently permitted under general permit NCG12. I understand and you concur, that a general permit does not require a renewal application 180 days in advance of its expiration and that the Mayo NCG 12 permit will be administratively extended after October if the modifications to the NPDES ISW permit are not complete. I also understand that this work will constitute a major modification of our NPDES ISW permit and a public notice and hearing will be required. Finally, based on the steps outlined here the Mayo monofill will at no time be without SW coverage as we work toward modifying our NPDES ISW permit. Thank you for your time yesterday.
