Mr. Holloway,
On August 8, 2018, the Division of Water Resources (Division) received your application dated August 5, 2018,
requesting a 401 Water Quality Certification from the Division for shoreline stabilization on your property. The Division
has reviewed the additional information and has determined the application is incomplete and cannot be processed. The
application will be placed on hold until the following items are addressed:
1. According to your application and subsequent email on August 16, 2018, the proposed retaining wall will
encroach onto Duke Energy property 4-5 feet. Please provide documentation from Duke Energy that the
proposed retaining wall/fill encroachment is authorized. [15A NCAC 02H .0502(f)]
In addition, you will want to reach out to Kevin Holloway with Duke to make sure your proposed wall meets their
specifications.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 days, the Division
will be unable to approve the application and it will be returned.
