Dear Mr-. Shuttleworth,
On January 1Q, 2006, the Division of'Water Quality (DWQ) in tl~e w'ilmingtan regional
UficG {WiRC) received youz~ application dated November 29, 2005 to review fQr the Division of
Water Quality (DWQ) impacts/concerns. la'wVQ has determined that your application Bras
incomplete andlor provided inaccurate ii~fornlatian as discussed below. TI1e L7WQ will require
additional infarznation in order- to process your application for potential impacts of prot+~cfied
wetlands andior streams on the subject property. Therefore, unless we receive the additional
information requested below, we trill have to move toward denial of your application as required
by 15A NCAC 2f-I A~06 and will place this project on hold as incomplete until we receive this
additional infannation. Please provide the following inforcnatian so that we may ooniinui: to
review yat~r proj eet.
Additional ,Information Requested:
1. 1'Icase provide a copy of the Signed Jurlsd,ictional dete~~-nination by the Corps of
Engineers.
2. Please pra~~ide a draft copy of the preservation language, restrictive covenants, deed
restrictions, dead notifcations or preservation language for the remaining wetlands on
the property. DWQ will require deed notifications; if the Corps of Engineers is more
restrictive we v~~ill accept a draft copy of their conservation language.
The 11 ~ 17 drawing of the overall project does not aIlotu DWQ to adequately
review the project for potential t~letlartd impacts. please send a plan size copy of
overall project so bWQ coax fully review the project.

~. On the application under the individually listed wetland impacts (IV 2), you indicate
that some of the impacts axe cllannelized dzainways. If these are streams, please list
them as such and include the length of impacts under Individually listed stream
impacts (I'~' 3)
5. On the drawings sliovying the enlargement of the individual impacts, the drawings are
not labeled as to which impact it shaves (A, ~, C, etc, , ..).
6. One: of the profiles for the wetland impact shows a pipe, but the enlarged drawing
indicates the pipe most likely isn't warranted (A11~y I3 beside Lot # 12~),
7. On the enlarged drawings with the prQ~les indicating that pipe(s) will Ue used to keep
the conductivity between the wetland, the plan viev;~s do not indicate pipe(s) or their
location
S. Onto of the enlarged drawings shoves that the house footprint will impact additional
wotlat~ds, These additional impacts are not included in the application, All impacts
must be includul in the application package, including all lot fills, All Iots must be
buildable without additional impacts to wetlands when the 40 ] is issued.
9. Please rc~-ise the l'CN and plans accordingly aa~d sulaJfnit revised aopios to thi,> office,
the 401 Oversight Office, and the USACE.
Please respond in writing within three weeks of the date oftltis letter by sending a copy ofthe
