Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the 714-lot subdivision and associated infrastructure, and the covered pavilion associated with the 50-slip marina, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 796-7215 for this determination. 2) Any development or land disturbing activity that is considered non-water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resources Commission (CRC) regulations in place at the time of such development. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. River Bluff Holdings II, LLC c/o Joseph Stillwell Permit #62-09 Page 2 of ADDITIONAL CONDITIONS Marina 3) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed and operable at an easily accessible location, and maintained for the life of the marina. 4) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 5) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) This permit authorizes a maximum of fifty formalized boat slips associated with the marina facility. y? ?1J?fK°'G+K?:?%Yr:+?:=?' Y_ River Bluff Holdings II LLC c/o Joseph Stillwell Permit #62-09 , Page 3 of 5 ADDITIONAL CONDITIONS } 13) No portion of the authorized marina, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. Sedimentation and Erosion Control 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Easement 16) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office at 919-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management at 400 Commerce Avenue, Morehead City, NC 28557, prior to construction of any new boat slips or other docking facilities authorized under this permit. Gazebo 17) The authorized gazebo located landward of the normal high water line shall not be enclosed. Benches and knee walls are permitted. Screening, doorways, and lattice is specifically excluded from being used under this authorization. 18) The roof of the gazebo shall not be designed for second story use. Stormwater 19) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8070677, which was issued on 1/3/08. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Boat Ramp 20) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 21) Excavation and ground disturbing activities above and below the normal high water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. River Bluff Holdings II, LLC c/o Joseph Stillwell Permit #62-09 Page 4 of 5 ADDITIONAL CONDITIONS 22) To ensure that the floating dock associated with the boat ramp does not rest on the bottom during periods of low water, permanent stops shall be installed so that all portions of the authorized floating dock remain a minimum of six inches above the bottom substrate. General 23) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted with the exception of those authorized impacts necessary for the construction of the boat ramp. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 24) Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment, dated February 2008, for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of the permit and any subsequent modifications. 25) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 26) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: The issuance of this permit was based in part on a review of the attached workplan drawings that appear to indicate that the property boundaries for Lots 240, 241, 242, 243, 244, 466 and 477 stop landward of the normal high water line, therefore allowing the development of this marina without riparian shoreline dedications for these lots. NOTE: The permittee is advised that the potable water line extensions to this marina, and other areas, must receive plan approval from the Division of Environmental Health-Public Water Supply Section prior to construction. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required.
