Winner, PO Box 1069, Carolina Beach, NC 28428 Authorizing development in New Hanover County W, bank Cape Fear River, S. of USS North Carolina Battleship Memorial, on Eagle Island , as requested in the permittee's letter dated 12/30/08 This permit, issued on June 9. 2009 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This renewal shall be attached to the original Permit No. 47-03, which was issued on 4/8/2003, as well as the renewal of 2/15/07, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 2) All conditions and stipulations of the active permit remain in force under this renewal. 1 ms permit action may be appealed by the permtttee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Winner Property - Permit No. 47-03 Proposed Dock/Wharf Facility on Eagle Island International Paper Road, Wilmington, NC HEA Project No. 00-1005 Dear Ms. Snider: Haggett Engineering Associates, Inc. (HEA) has prepared this letter in order to request a two year extension to CAMA permit 47-03 that was originally issued on April 8, 2003. A two year extension to the original permit was granted on February 15, 2007. The permit will expire on December 31, 2008. The following are submitted in accordance with the requirements of 15A NCAC 07J .0404 (b): The proposed dock and wharf to be constructed under this permit have been delayed by loss of the development proposed for the land-side of the project. As you may be aware, Mr. Winner had the project under contract with a development group that planned to construct a convention center on the site. Poor economic conditions and a lack of support from the City caused this key component of the project to fail. Therefore, work approved under this permit has not been started. Mr. Winner plans to proceed with the construction of the dock and wharf facility as soon as possible. 2. As noted in Item 1 above, the proposed land-side portion of the project has failed due to the poor economic conditions and lack of support from the City of Wilmington. Mr. Winner is working to develop an alternate plan for the development of the property. The development plan will likely be a scaled down version of the original Convention Center conceived for the site. Some type of land- side development is needed to support the proposed dock and wharf approved under the permit. As noted in the original application, the primary use for the dock and wharf facilities will be for Mr. Winner's charter boats. The plans for the proposed dock and wharf approved under this permit have not changed. 4. The property has not changed ownership. 5. The project is in compliance with the conditions of the permit and permits issued by other agencies. We are enclosing the following items with this letter: 1. Copy of the original permit 2. Copy of the extension issued on February 15, 2007 3. Copy of the site plan 4. Check in the amount of $100 for the extension fee.
