Dear Mr. Butts:
On September 23, 2008 the Division of Water Quality (DWQ) received your revised
application dated September 19, 2008 to impact 0.07 acres of for the purpose of
constructing an access road to private parcel. The DWQ has determined that your
application was still incomplete and/or provided inaccurate information. The DWQ will
require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Since this project was put on hold for
additional information on November 4, 2008 the DWQ has not received the required
response in the timeframe allocated and will withdraw your application. If you want to
carry out this proposed impact, you will need to reapply and pay the 401 Certification fee
again. If you want to reapply, please provide the following information so that we may
review your project.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Kyle Barnes
