In late March 2009 it became apparent that a small section of wetland was mistakenly filled for the purpose of a road crossing and the installation of a retaining wall. The retaining wall was intended as an avoidance and minimization technique to reduce the fill slopes of the roadway crossing through the wetland area. This wetland area was shown on the original plans approved by the USACE and NC DWQ in the 2007 Permit Modification submittal. There have been no changes to the site plans that were submitted. On April 29, 2009, Mr. Monte Matthews (USAGE) and Ms. Lauren Witherspoon (NCDWQ-RRO) reviewed the unpermitted wetland impact area. The small amount of current wetland impact totals approximately 0.075 acres, which is currently under fill. Per conversations with Mr. Norm Ledger (GS Carolina), the applicant, Pulte Homes, is proposing to leave 0.032 acres of the fill in place. This fill is necessary for the road and the structural integrity and future maintenance of the retaining wall. The applicant is, however, proposing to restore 0.043 acres of wetland by removing the fill currently in the wetland and restoring the area to pre-impact contours. Additionally, the restored wetland will be planted with a wetland seed mix and native woody species (see attached planting plan). The applicant is also proposing to add two additional areas ("A" and "B" on the attached sketch map) in the restoration efforts which will total 0.050 acres of supplementary wetland restoration. These areas will also be seeded with native wetland seed mix and planted with native woody species. A third area ("C" on the attached sketch map) exhibits wetland conditions and therefore, the applicant is proposing to include this area into the wetland restoration efforts. This will result in an additional 0.026 acres of wetland restoration. In total, the applicant is proposing to restore or create 0.076 acres of wetland in this area. These wetland restoration/creation areas are not proposed as or required to be compensatory mitigation and therefore are not subject to any monitoring requirements. This plan was preliminarily discussed, and approved, by both Mr. Matthews and Ms. Witherspoon. Carolina Preserve by Del Webb at Amberly A/R Phase 3 June 4, 2009 Soil & Environmental Consultants, PA Project No. 1089 The final total of wetland that is proposed to remain as permanent impact will be 0.032 acres. In 2007, the applicant was required to provide 0.18 acres of riparian wetland restoration through the NC Ecosystem Enhancement Program (EEP) [see attached EEP Invoice and Receipt]. The EEP, however, only provides mitigation in quarter acre increments (i.e. 0.25). Therefore, the applicant was required to pay for 0.25 acres of riparian wetland which results in an excess of 0.07 acres of riparian wetland mitigation beyond what the USACE required. Therefore, for permanent impacts to 0.032 acres of riparian wetland at a 2:1 mitigation ratio, 0.064 acres of compensatory wetland restoration would be required. The applicant is not proposing any additional mitigation for the permanent impacts to the riparian wetland as there is 0.07 acres of excess compensatory wetland mitigation which has been provided by EEP. Note that this does not include the addition wetland creation proposed at the impact site. Also, during the remainder of the site visit on 4/29/09, Mr. Matthews and Ms. Witherspoon conducted an inspection of the remainder of Phase 3 for compliance with current, approved permit limits. Both determined that the site was in compliance, however, there were 3 areas of concern. These areas include: 1) A check dam below impact No. 7 which will need to be removed; 2) Sediment and gravel immediately below impact No. 6 which will need to be removed; 3) Sediment within the riparian area below impact No. 6B which will need to be removed Mr. Bob Zarzecki met with Mr. Norm Ledger (GS Carolina) on May 11, 2009 at the site and reviewed the above areas of concern. The check dam and sediment below impacts Nos. 6 and 7 will be removed and the sediment below impact No. 6B in the riparian area will be removed and the area will be seeded and mulched. Mr. Ledger believed that the sediment was the result of the construction of the sediment basin in the vicinity and noted that the sediment basin is currently in working order. The necessary work will be done immediately. Finally, there was a 0.508 acre pond on-site noted on the Jurisdictional Determination (JD) maps (AID 200220442). This pond is in the south west corner at the intersection of O'Kelly Chapel Road and Yates Store Road. This pond was drained and evaluated by Jamie Shem (USACE) on December 19, 2007 and determined not to be jurisdictional.
