PROJECT DESCRIPTION: The project is located at 300 Windchase Lane, adjacent to Whiskey Creek and the Atlantic Intracoastal Waterway (AIWW), Wilmington, in New Hanover County. To locate the project site from Market Street (Highway 17), travel South on College Road towards Monkey Junction. At the intersection of South College Road and Holly Tree Road turn left. Continue east on Holly Tree Road, and bear right at he stoplight onto Pine Grove Drive. Continue on Pine Grove Drive, which will converge with Masonboro Sound Road. Travel on Masonboro Sound Road approximately 2.3 miles turning left onto Cabbage Inlet Lane. Follow Cabbage Inlet Lane for approximately 0.3 miles, turn left onto Windchase Lane. The project site will be located on the right near the end of the road. The 0.05 acre tract is irregular in shape and has approx. 100 feet of shoreline fronting Whiskey Creek. The property has an average elevation of 6-12 feet above mean sea level. Existing man-made features on the project site include a 1-story storage building, a concrete and oyster shell boat landing (approximately 10-15 feet in width) and an existing fixed and floating docking facility. The project site is a deeded community access area for the adjoining lots; 340, 344, 350 Cabbage Inlet Lane and 314 Windchase Lane. Highround portions of the tract and the adjacent properties were home to the former Uncle Henry Kirkham's Oyster House Restaurant, reportedly operating from 1940-1990. The landing location has been historically used by commercial fisherman and the public for oyster production. The project site was formerly home to an oyster shucking facility that sold oysters to wholesale and retail markets. The oyster house and commercial boat landing have not operated actively since the late 1980's and early 1990's when the area was developed with single-family residences. Located waterward of the highground is an existing band, approximately 10-15 feet in width, of Coastal Wetland vegetation consisting primarily of Smooth Cordgrass (Spartina alternaflora). Wetland vegetation is void in the area of the existing concrete and oyster shell boat launch. An existing fixed pier with platform connects to a large floating dock oriented parallel to the shoreline with a single finger pier perpendicular to the shoreline. The existing floating docks currently rest on the bottom during periods of low tide. Located waterward of the pier adjacent to Whiskey Creek are two large oyster beds that create a bay in which the pier is located. Aerial photography indicates the existing pier was constructed between 1995 and 2000; however DCM has been unable to locate any permit data for this structure. Although the applicant states that the channel has been historically used and maintained, there is no record of previous excavation being conducted in this area. The applicant has provided photographs (see application), to demonstrate that a natural channel existed prior to the development of Masonboro Boat Yard. Furthermore, the applicant states that several storm events have caused this area to shoal, severely limiting the access to Whiskey Creek. The Wilmington- New Hanover County Land Use Plan classifies adjacent highground and waters of the project site as Conservation. The waters of Whiskey Creek, in Masonboro Sound, are classified as SA- HQW, by the NC Division of Water Quality. The waters adjacent to the project site are also designated as Outstanding Resource Waters by the Environmental Management Commission. These waters are designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant is proposing to dredge a channel and improve an existing boat ramp. The applicant is proposing to excavate an area which is said to have been historically used for navigation. In addition the applicant proposes to improve to the existing community boat launch area. The applicant states that mechanical dredging would be utilized to excavate a historical channel measuring approximately 475 feet in length by 25 feet in width. The applicant states the existing water depths range from approximately 0 feet to -0.8 feet at Normal Low Water (NLW). Water depths adjacent to the existing docking facility are +0.2"at NLW and increase to -2.0' at NLW at the end of the channel, adjacent to Whiskey Creek. The applicant is proposing to dredge all areas to a final depth of -3' at NLW. The Stuart Point Cabbage Inlet Lane Landing Maintenance Project Page 3 applicant states that dredging is necessary to provide access to the channel and Whiskey Creek for the use of boaters. The resulting dredge material would be located on the adjacent highground. The dredge material disposal site is irregular in shape and is approximately 10,000 square feet. The proposed dredge material disposal site would be located 30 feet landward of Normal High Water and existing Coastal Wetlands. The spoil disposal site would be surrounded by silt fence to prevent the run- off, material would be dewatered, and utilized onsite. The applicant states this area is of sufficient size to accommodate the proposed spoil. The applicant is also proposing improvements to the existing sand and oyster shell boat launch. The proposed boat ramp improvements would include the placement of preformed sections of concrete within the existing footprint of the existing sand and shell boat ramp. The proposed new concrete ramp would measure15 feet in width and would have an overall length of 40 feet. The applicants drawing shows that the boat ramp will be located no more than 20 feet below NHW. 11. ANTICIPATED IMPACTS: Based on the submitted drawings and the scaled dimensions measured, the proposed excavation would result in the removal of approximately 1,219 cubic yards of dredge material from the 475 feet long historical channel. The applicant states that approximately 1,305 cubic yards of material would be excavated from below NHW and spoil calculations were derived using an engineered computer program based on the submitted hydrographic survey and cross section bottom contours. The proposed dredging would result in the disturbance of approximately 11,875 square feet of open water. The dredging activity would result in a temporary increase in turbidity. The improvements to the boat ramp would result in a concrete ramp measuring 15 feet in width and would have an overall length of 40 feet. The boat ramp would extend approximately 20 feet below NHW. The boat ramp would result in approximately 300 square feet of concrete fill to be pushed into place below NHW. No grading of the shoreline has been proposed in conjunction with the boat ramp. No wetland fill or excavation is proposed. Submitted by: H. Snider Date: 613109 Office: Wilmington Cabbage Inlet Lane Landing Project 350 Cabbage Inlet Lane Wilmington, New Hanover County, North Carolina ECS Project 22-14427A March 10, 2009 1.0 PROJECT NARRATIVE 1.1 Development History and Use: The subject property is located at 350 Cabbage Inlet, adjacent to the Windchase subdivision, off Masonboro Sound Road, in Wilmington, New Hanover County, North Carolina. The property is located adjacent to Masonboro Sound/Atlantic Intracoastal Waterway (AIWW) and the mouth of Whiskey Creek, also know as Purviance Creek, which is across from Masonboro Boat Yard (Figures 1 and 2). Existing manmade structures on the property are a single-story garage, an active community boat landing and a private dock that was constructed in the spring of 1997. The facility extends towards Whiskey Creek, running adjacent to the existing landing and channel. The pier measures approximately 95 feet in length by 6 feet in width that terminates into a "T-head" platform, measuring approximately 8 feet in length by 16 feet in width. An access ramp leads onto a floating dock, measuring approximately 36 feet in length by 6 feet in width that runs parallel to the shoreline. A finger pier, measuring approximately 14 feet in length by 3 feet in width extends from the western end of the floating dock, perpendicular to the shoreline. Existing highground vegetation on the property consists of lawn grass and Live Oak trees. Waterward of the highground is an existing band of coastal wetlands approximately 10 feet in width that is located along the shoreline of the property that consists primarily of smooth cordgrass (Spartina alterniflora) (Sheet 1 of 2). The subject property and the adjacent riparian property to the south located at 344 Cabbage Inlet Lane is the location of the formal Uncle Henry's Oyster House Restaurant that reportedly operated from approximately 1840 through 1990. The oyster house was destroyed by Hurricane Hazel in 1954 and soon rebuilt. The landing location has been historically used by commercial fishermen that sold their landings to the oyster house, which until the 1970s was an oyster shucking facility. Reportedly, the business grew into bulk sale of oysters by the bushel to the public and also to patrons of the restaurant. The landing provided access to a natural channel that runs south approximately 450 feet towards the main stem of Whiskey Creek that provided access into Masonboro Sound/AIWW. The existing landing was also used by the Kirkum family that owned these properties to access for recreational use within this timeframe. Evidence of the origins of the landing still exists with the oyster cultch that was utilized for creating the boat landing and construction of berms for shoreline stabilization for the landing and properties. During the early 1970s Masonboro Boat Yard was constructed that required a substantial amount of excavation for the basin and its associated access channel to the AIWW. Following the excavation was the construction that included the water dependent structures such as floating docks and associated pilings to accommodate the proposed slips. During the late 1980s and early 1990s, waterfront properties in this area of North Carolina were in high demand. Development of the Windchase subdivision and associated community marina occurred in 1988 and the sale of Uncle Henry's Oyster House property in 1991 that followed (Figures 3-14). The old building was demolished and the construction of the existing single- family house currently located on this property was built in 1994 that incorporated the old foundation of the old building into the patio area of the new house. During the late 1990s this area of North Carolina experienced major hurricane activity that included Hurricanes Bertha and Fran in 1996, Hurricane Bonnie in 1998 and Hurricane Floyd in 1999. Since these major events over the last three decades the local residents have experienced limited access to Masonboro Sound via Whiskey Creek through the use of the landing and the historical natural channel. Property owners that have continued grandfathered rights to the existing landing include 314, 340, 344 and 350 Cabbage Inlet Lane, and 314 Windchase Lane (Figures 15-17). R£"::C....EIviErD 3 _ UIN 0 3 2009 Cabbage Inlet Lane Landing Project 350 Cabbage Inlet Lane Wilmington, New Hanover County, North Carolina ECS Project 22-14427A March 10, 2009 1.2 Water Classifications, Zoning, and Adjacent Uses: Whiskey Creek in this location is classified as SA-HQW by the N.C. Environmental Management Commission, indicates the state deems the project waters suitable quality for shellfishing for the purpose of marketing or human consumption; however, this area of Whiskey Creek is closed to the harvesting of shellfish by the N.C. Department of Environmental Health Shellfish Sanitation and Recreational Water Quality Section. The project area is designated as a Primary Nursery (PNA) by the N.C. Marine Fisheries Commission. The local zoning for the City of Wilmington classifies the project area as Residential. 1.3 Proposed Development_ The applicants of the aforementioned properties propose the opportunity of maintaining the historical use of the natural channel that is located between the existing landing and the main stem of Whiskey Creek. A hydrographic survey of this location conducted on December 3, 2008 depicts the existing water depth based at mean low water (MLW) (Appendix A). Dimensions of the proposed maintenance excavation would be approximately 470 feet in length by 25 feet in width with a final project depth of -3 feet at MLW. Approximately 1,305 cubic yards (cy) of material will be removed mechanically and placed on a designated highground area of approximately 9,200 sq. ft. located on the property. The excavated material will be landward of the 30 foot setback requirement from normal high water (NHW) and existing coastal wetlands with proper sedimentation and erosion control measures. Once the material is de- watered, the material would be utilized on-site. The applicants also propose to maintain the existing landing with the placement of pre-formed sections of concrete type material, measuring approximately 20 feet in length by 15 feet in width. The boatramp will be located no more than 20 feet below mean high water (MHW) and within the footprint of the existing historical landing (Figures 18, 19 and 19A). In October 2008 a meeting was held on-site at the request of the applicants with Mr. Rich Carpenter, Wilmington District Manager with the North Carolina Division of Marine Fisheries (DMF), and Mr. Mike Christenbury, Wilmington District Planner with the North Carolina Division of Coastal Management (DCM). The meeting was timed at a typical low tide to demonstrate the existing conditions and concerns of the local residents on the limited access to the creek. The meeting was also held to go over the potential of maintenance of the landing and access channel, and potential concerns the interested resource agencies may have on the project prior to submittal of a CAMA Major Development Permit application. Further, the meeting was held to determine its consistency on the local Wilmington/New Hanover County 2006 CAMA Land Use Plan, specifically Policy 3.2 under Section A: Natural Resources, which addresses dredging activities in sensitive areas that includes PNAs. The historical aerial photography and background of the site were reviewed and discussed. An on-site meeting was held on January 28, 2009 at low tide with Ms. Holley Snider, Field Representative with the DCM to discuss the project and the pre-application process. 2.0 CONCLUSIONS Based on the historical and continual use of this natural channel and the boat landing, it is the opinion of ECS that the site is eligible for the CAMA Major Development Permit for the maintenance excavation. This will allow the applicants and the properties owners with the rights to the landing the ability to continue its use to the local waterbodies and the resources they provide.
