Please find enclosed the necessary documentation for a Pre-Construction Notification for the above
referenced project. This project involves the construction of 7956 linear feet of 18" sanitary sewer
impacting less than one acre of wetlands and less than 150 feet of streams. I have also included the
required fee of $240.00, and I am sending one set of documents to the US Army Corps of Engineers.
The City of Rocky Mount will own and maintain this sewer line. We anticipate putting the project out
for bid in August of this year. We hope to begin construction in September.

mechanical equipment to construct the sewer line, but all wetlands and buffers will be restored to original grade upon

2 Tar-Pamilco riparian buffer.

The alignment has been designed to avoid wetlands, Tar-Pamlico buffers, and excessively deep manholes. As mentioned in
6i, the only reason for the Zone 1 impact of 250 SF is to allow a tie-in to the existing 18" DIP under Interstate 95.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
In the areas where we must cross wetlands or Tar-Pamlico buffers, proper erosion control measures will be implemented and
a post-construction survey will verify restoration to original grade. Mats will be used to minimize the impact of construction
equipment. The timing of the project (August - November 2009) is to take advantage of the driest time of the year in this area.
If, for some reason, the project cannot be started by September, we will delay the project until April 2010 to avoid the
traditionally wet season of November-March.

The City of Rocky Mount commits to requiring on-site stormwater management measures, such as
riparian buffers, bioretention cells, constructed wetlands, and level spreaders, for any additional
development on parcels adjacent to this sanitary sewer interceptor corridor. All development will be
required to meet stringent water quality requirements in accordance with the City of Rocky Mount's
Land Development Code, the City of Rocky Mount's Stormwater Management Program, the Tar-
Pamlico River Basin Riparian Buffer Protection Rules, and the Tar-Pamlico Nutrient Management
requirements.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including SL 2008-152: An Act to Promote
Compensatgry Mitigation by Private Mitigation Banks,
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fedto be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.

Upon receipt of payment, EEP will take.responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed
in accordance with the Memorandum of Understanding between the N.C. Department of Environment and Natural Resources and the
U.S. Army Corps of Engineers dated November 4, 1998.
