Dear Mr. Jennings:
On August 6, 20l 8, Garcy Ward of the North Carolina Division of Water Resources (NCDWR) Washington
Regional Office conducted an on-site inspection of project TIP B-5604, the replacement of Bridge No. 19
over Mill Creek on US 17 Business, in Perquimans County. In addition to NCDWR staff, Kyle Barnes
with the US Army Corps of Engineers and Paul Williams and Andy Blankenship with NC DOT were also
present during the inspection and their time and assistance is greatly appreciated.
During the inspection, a review of the NCGO 10000 inspection forms revealed they were not being properly
completed. The inspection forms stated that there were no Stormwater Discharge Outfalls (SDO's) on the
project, and there was no record of them being inspected as required despite there being eight SDO's on
the project.
The actions described above led to the following violation(s):
1.) 401 WQC conditions violation:
The NCDWR authorized the impacts for the subject project under General Water Quality Certifications
(WQC) No. 4132 and 4133, NCDWR project number 20180118. Condition 8 of WQC Nos. 4132 and
4133 states the following:

The North Carolina Departrne�at of Transportation (NCDOT) shall be �•eqz�ired to be in,firll
compliance with the conditio��s related to construction activities within tlze n�ost recer�t
version of their individual NPDES (NCS000250) stormwater perr��it.
Failure to properly inspect the SDO's and complete the inspection records represents a violation
of NCS000250 and therefore constitutes a violation of this condition.
2.) NPDES (NCS000250) and NCGO10000 permit violations:
Failure to properly inspect the SDO's and complete the inspection records does not meet the
requirements set forth in NCS000250 Part II, Section C(1)(b)(ii) of NCDOT's individual NPDES
permit and the self-inspection and reporting requirements specified in NCGO 10000 Section
II.B(3).
Accordingly, you are directed to respond to this letter in writing within 3� calendar days of receipt of
this notice.
Your response shall include the following:
• List any actions necessary to remediate the violation and prevent it from happening again.
