Dear Mr. Baker,
The North Carolina Department of Transportation (NCDOT) is proposing to replace Bridge
Number 15 on SR 1331, over Owl Creek in Cherokee County. The existing bridge is a
single span steel beam with concrete encasement on the beams and masonry abutment
structure (30 feet). It was determined that in the interest of public safety, that this bridge be
replaced because of deterioration due to age, insufficient width and accident history.
The proposed replacement will be a cored slab structure widened to 36 feet and lengthened
to 80 feet. Both end bents will be constructed away from the water; therefore, no in stream
work is anticipated except for removal of the existing structure. The bridge will remain open
for the duration of the project with the new structure being constructed downstream. If
needed, sandbag cofferdams will be used to ensure a clean, dry area, and to minimize
impacts to aquatic habitats and allow the existing stream gradients to remain as unchanged
as physically possible.
The North Carolina. Natural Heritage Database was checked for records of threatened or
endangered species. There are no records of threatened or endangered species for the bridge
site. Additionally, there are no records for the entire Owl Creek watershed. The impacts
within the water will consist of removal of the old bridge structure and will have very
minimal effect on the habitat within Owl Creek. For these reasons, we believe this project
will have "no effect" on threatened or endangered species.

The State Historical Office has reviewed this project and did not find any significant
historical structures that would be impacted. An archeological survey was performed at the
bridge site and no significant archaeological resources were found. Documents on historical
and archeological resources attached.
The best management practices will be used to minimize and control sedimentation and
erosion on this project. The construction foreman will review all erosion control measures
daily to ensure devices are functionng properly. If the devices are not functioning as
intended, they will be replaced immediately with better devices.
Impacts to Waters of the United States
Owl Creek (Class C) is shown on the USGS topographic map as a perennial stream. The
channel is approximately 24 feet in width and is composed primarily of cobble, gravel and
sand. The channel lacks vegetation. Owl Creek has sufficient flow to support fish and other
aquatic life. Owl Creek flows approximately 1.6 miles to Hanging Dog Creek. Hanging
Dog Creek then flows approximately 4.8 miles to the backwaters of Hiwassee Lake.
Hiwassee Lake meets the definition of a Traditional Navigable Water. For these reasons, we
believe that Owl Creek meets the definition of a Relatively Permanent Water and is under the
jurisdiction of the U. S, Army Corps of Engineers. In order to construct the project, it will
be necessary to impact waters of the United States in the Hiwassee River Basin.
Specifically, NCDOT is requesting to replace Cherokee County Bridge # 15 with a cored
slab spanning structure. Listed below is a summary of the proposed impacts.

proceed with the construction project outlined above. By copy of this letter, I am asking
Mr. David McHenry, Mountain Region Coordinator, of the North Carolina Wildlife
Resources Commission (NCWRC) to comment directly to you concerning the 404 General
Permit request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean
Water Act from the North Carolina Department of Environment and Natural Resources

Bridge 15 in Cherokee County is a single span timber floored bridge that we are proposing to rebuild using new materials.
The existing bridge will be removed and a 80-foot long concrete box beam structure will be erected. The general land use
