PROJECT SUMMARY: The applicant is proposing to construct a 6'x 457' boardwalk on the upland portion of the property along the northern side of the existing canal, and construct a fixed/elevated 6' x 390' pier/platform, along the northern shoreline of the canal for boat dockage. Lawrence Ward Page Two 9. PROJECT DESCRIPTION: Please refer to the Field Investigation Report (FIR) for Lawrence Ward (Cedar Point Subdivision), prepared by Jason Dail and circulated on 3/3/2004. CAMA Major Permit No. 68-04 was issued to Mr. Lawrence Ward on 5/17/04 for development of Cedar Point subdivision. The permit authorized the development of a subdivision including: lot grading/preparation, street access and utilities installation, maintenance dredging within the existing canal and access channel, construction of 2,000 linear feet of bulkhead along the canal's southern shoreline, construction of a 40' X 12' boat ramp with a 34' X 4' handling pier, five (5) piers (20' x 4') within the canal, and a 6' x 100' pier extending into Banks Channel with a 6' x 20' t-head platform, a 20' x 20' gazebo and two (2) 4' x 15' floating docks (one located on each side of the platform. The waters of the Topsail Sound and Banks Channel, adjacent to the proposed project area, are classified "SA" by the Division of Water Quality. This section of Topsail Sound is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to construct a 6' x 457' boardwalk on the upland portion of the property along the northern side of the existing canal, and construct a fixed/elevated 6' x 390' pier/platform, along the northern shoreline of the canal for boat dockage. The proposed boardwalk would begin at the terminal end of the cul-de-sac, adjacent to lot 13. The 6' wide boardwalk would extend towards the northwest approximately 457' and would run parallel to the shoreline. A 6' x 25' section of the boardwalk would cross over a narrow strip of "404 type" wetlands, while the remaining section would be located on high ground. Four (4) 6' x 10' ramps/walkways would connect the boardwalk to the proposed 6' x 390' elevated pier/platform. The proposed pier/platform would be located on the southern side of the northern shoreline bordering the canal. According to the site drawings, the proposed pier/platform would be located approximately 3' above Mean Low Water (MLW). The pier/platform would provide dockage for up to thirteen (13) vessels. 10. ANTICIPATED IMPACTS: The proposed boardwalk and walkways would disturb approximately 2,712 sq. ft. of high ground. A 6' x 25' section of boardwalk, as proposed, would shade approximately 150 sq. ft. of "404 type" wetlands. The proposed pier/platform would incorporate approximately 2,460 sq. ft. of estuarine and public trust waters. According to Division of Environmental Health, Shellfish Sanitation Section, the proposal to create thirteen (13) additional slips would not create a shellfish closure. M N ENVIRONMENTAL ASSESSMENT COMMUNITY DOCK AT CEDAR POINT AT SURF CITY TOPSAIL SOUND PENDER COUNTY, NORTH CAROLINA AUGUST 4, 2004 SCOPE: Authorization for construction of the Community Dock at Cedar Point at Surf City addressed in this Environmental Assessment has been requested in the form of a Major Modification to the recently issued Major CAMA Permit No.68-04 which provided approval of the overall Cedar Point at Surf City Subdivision. Since that issued permit addressed all of the landward features of the overall subdivis on project, including the dredging of the adjacent inland canal and 9 dock spaces, this Environmental Assessment is limited to addressing only the impacts of the proposed 13-space Community Dock for use by the 13 interior lot owners. A. PROPOSED PROJECT DESCRIPTION General. The Cedar Point at Surf City Subdivision is a 22-residence subdivision on a 5+-acre tract varying 4" to 10' above sea level located along the western shore of Surf City, N.C. It is approximately 2.9 miles south of NC Highway 210 between NC South Shore Drive and Banks Channel in Topsail Sound in the Town of Surf City, Pender County, N.C. The Cedar Point at Surf City Subdivision has been previously platted and was the subject of review for a Major Coastal Area Management Act (CAMA) Permit No. 68-04 issued on May 17, 2004. That permit authorized construction of a bulkhead with backfill, a boat ramp and boat handling dock, 5 1-space docks, one 4- space dock, and maintenance dredging of the existing canal and access channel. It also authorized the filling of 0.04 acres of 404 wetlands. Other approvals of the subdivision are: Stormwater SW8- 030526, Sewage (Surf City) WQ-0022751, Sedimentation & Erosion PE03267, Water (Surf City) 0471015 (DEH Ser# 0300974, NCDWQ General Water Quality Certification #3400 (Project No. 040358), and Corps of Engineers approval ID No. 200400424. The Town of Surf City has also issued various approvals for the subdivision. The scope of this Environmental Assessment, therefore, is limited to assessing the impact of the construction and operation of a 13-space pier 390' x 6' located along the northern shore of the existing canal with access to the pier by way of an elevated boardwalk that spans all wetlands, either coastal or 404. This proposal will provide water access and boat docking space for the residents of the 13 interior lots not located on the shoreline. CAMA Permit 68- 04 provided access for the 9 shoreline property owners. The Developer is S & W Investments, Mr. Lawrence Ward, 4616 Gomar Lane, Fuquay-Varina, NC 27526. The proposed pier will be located entirely along the shoreline of the Cedar Point subdivision within the existing dredge-maintained canal. Other residential docks are located adjacent to neighboring properties to the north and south. Dock Description. The dock will be located along the northern shoreline of the existing can proposed to be 6' wide by 390' long and provide one boat space for each of the 13 inte ' rs of the subdivision. It is proposed to extend about 10' waterward of the mean ' b ?i in a water depth of about 2.5' at mean low tide. The dock will be accessed by 'dwalk that?va?y wa be located on high ground, parallel to the dock with four ramps out to the dock. a board ?n$ ramps will be elevated so as to span any wetlands or tidal areas. The purpose of this project is to provide recreational water access for the residents of each of the 13 lots within the Cedar Point at Surf City Subdivision that are not located on the shoreline. The need for the project is embraced by the goal of the developer of providing quality housing in a quality neighborhood where residents can enjoy the adjacent waters of Banks Channel and Topsail Sound for recreational boating, fishing, crabbing, and quiet contemplation. The location of the Cedar Point at Surf City project affords the unique opportunity for the realization of these goals. Additionally, the provision of water access allows the developer to expect a realistic price for the residential lots, not necessarily for greater profit, but to offset the greater cost of this tract of waterfront property. C. ALTERNATIVES ANALYSIS. 1. BOAT RAMP ONLY. A boat ramp is already included for this subdivision that will serve to allow boats to be launched and removed from the canal for day trips or other occasions. There is very limited parking or other space that would accommodate the water access for the fnteiior residents by using only the boat ramp. 2. DO NOTHING. This alternative would not meet the goals and needs of the project, nor would the interior residents enjoy the water related activities. 3. CONSTRUCT A COMMUNITY DOCK (PREFERRED ALTERNATIVE) This is the least environmentally damaging alternative that would satisfy the needs of the Cedar Point at Surf City project that have been identified. This alternative not only provides the desired and needed water access for the lot owners, but it limits construction to one structure in the water. D. EXISTING ENVIRONMENTAL CHARACTERISTICS OF THE PROJECT AREA. The existing artificial canal within the Cedar Point at Surf City Subdivision was excavated several years ago and has continued to have a depth of up to -6'mlw. Dredging authorized by CAMA Permit 68-04 provides for a 30'-wide by 450'-long canal with a 20'-wide by 400'-long access channel. This canal/channel system will continue to be subject to occasional maintenance dredging. Scattered marsh exists along the shoreline of the canal and will not be disturbed by dredging within the 30' wide area. Scattered shellfish and various benthic species (fiddler crabs, etc.) will remain along the canal shore. The area is designated as a Primary Nursery Area and a variety of juvenile and small finfish, crabs, and local species are present. E. PREDICTED ENVIRONMENTAL EFFECTS OF THE DOCK 1. TOPOGRAPHY. No impact 2. SOILS. Insignificant impact caused by jetting piling during construction. 3. LAND USE. No changes inland use will occur because of this structure which is consistent with the Surf City Land Use Plan. 4. WETLANDS. The dock structure and ramps will be elevated well above all coastal and/or fresh marsh. 5. PRIME or UNIQUE AGRICULTURAL LANDS. No impact _ 6. PUBLIC LANDS and SCENIC, RECREATIONAL, and STATE NA\? \ AREAS. Topsail Sound is Public Trust Water, within which water-dependent struit es, such J its*' are allowed. `ON -'r-wo Page 2 PcJ? P? 7. AREAS of ARCHAEOLOGICAL or HISTORICAL VALUE. No impact 8. AIR QUALITY. Exhausts from the motors of the small boats using these facilities will have short-term minor impacts on air quality. The locations of the dock is in wide-open areas where wind movement is unrestricted and will quickly dissipate exhaust gases. 9. NOISE LEVELS. Noise during construction will occur for a few days. Noise from the motors of the boats will be minor and not unlike the existing boat noise in the area. 10. WATER RESOURCES (SURFACE WATER AND GROUND WATER).. The tidal surface waters of Topsail Sound are designated as a "Primary Nursery Area" by the North Carolina Division of Marine Fisheries and are classified "SA" by the North Carolina Division of Water Quality. The waters are open to the taking of shellfish. Restrictive covenants will be imposed by the developer to limit boats using the dock to 24' or less in length and preventing the presence of cabins or heads. Accidental spills will be quickly dissipated by the full range of twice-daily tides present in the area. 11. FOREST RESOURCES. No impact. 12. SHELLFISH or FISH and THEIR HABITATS. The construction of the dock will affect some scattered shellfish. The day to day usage of the facility will result in some spillage of fuel and oils, but no overboard discharge from onboard sanitary facilities will occur since the developer has imposed restrictive covenants that prohibit the length of boats to 24' or less, and without cabins or heads. No fuel facilities will be located on the dock. No shellfish closure will be imposed for this facility since only a total of 22 boat slips are proposed and the boats are limited in size to 24' with no cabins or heads. There are finfish, crab, and shrimp resources in these waters, none of which are anticipated to be significantly adversely affected by this project. 13. WILDLIFE and NATURAL VEGETATION. Waterfowl use this area for feeding and resting as well as do occasional otter and other mammals. This dock and its use will not add significant disturbance to these species beyond that which they experience from the existing similar facilities on other properties. 14. INTRODUCTION OF TOXIC SUBSTANCES. Only lumber and timbers subjected to acceptable treatment methods will be use in the construction of these piers. No other substances other than rare accidental minor petroleum spills will be introduced. 15. CONSTRUCTION. ' A 6'-wide boardwalk will begin in vicinity of the permitted boat ramp and extend on high ground for approximately 400' along the north shore of the existing canal. The boardwalk will be located landward of any coastal or 404 wetlands and will be elevated as a bridge across a 404 wetland slough about 25' wide. Four elevated ramps are proposed to be spaced about 100' apart to provide access to the dock, which is located within the waters of the canal. The dock is proposed to be 6' wide and 390' long with 13 30-ft boat spaces designated along its length. The face of the dock will be about 10' waterward of the mean high water into about 2 '/z feet of water at mean low water. This construction work will involve jetting and/or driving timbers into the ground and constructing the pier using conventional fasteners (nails, etc.). Noise will be generated during construction.
