Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site is located off Wells Dr. approximately 1 mile from downtown Forest City, NC. Work was conducted within the easement owned by the Town of Forest City. The project site encompasses approximately 234 linear feet of stream along the left bank of Bracketts Creek. During recent flood events several feet of the left bank was lost due to severe bank erosion. Erosion was so severe in some areas, previously buried sanitary utility lines were exposed, making these pipes vulnerable to deterioration and physical damage. To prevent damage of the lines, maintain sanitary service to citizens dependent on these utilities, and avoid degrading water quality with a breach, the eroded bank that was jeopardizing buried utility lines was repaired by the Town of Forest City's Public Works Department by covering eroded areas of the bank with rip rap. This was a necessary emergency repair. The entire project site is located within the floodway of Bracketts Creek and there are no jurisdictional wetlands on site. Bracketts Creek is the only jurisdictional water on the site. A majority of the easement on which the project site is located is mowed periodically. North of the project site is developed single family residences. West of the site is lightly used agricultural fields and single-family residences. South of the project site is forested land, lightly used agricultural fields, and single-family residences. East of the site are several multifamily residences as well as single-family residences. 4b. Explain the purpose of the proposed project:* The purpose of the work conducted at the project site was to immediately stabilize approximately 234 linear feet of severely eroded streambank along Bracketts Creek, which was damaged by recent flooding conditions in late April, early May 2018. The flooding conditions caused severe erosion of the streambank, which in some areas exposed utility lines making them vulnerable to failure, which could impact citizens dependent on the utility lines, and cause several environmental and public health issues if a failure were to occur. 4g. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* This project involved the stabilization of approbmately 234 linear feet of a severely eroded, flood damaged bank along Bracketts Creek. This project was undertaken to preserve the integrity of the remaining stream bank and to immediately protect vulnerable sanitary utility lines along Bracketts Creek to prevent a failure. The stabilized section of bank involved the installation of rip -rap. Eroded areas were graded back to produce a 2:1 sloped bank. A course backfill was then placed around exposed utility lines, covered with filter cloth, and then rip -rap was installed to the pre -flood location of the river bank. Temporary stream impacts included the access and installation of a work area for dump trucks to place rip -rap and backfill on the eroded areas. Rip -rap was placed only on severely eroded areas that were jeopardizing the integrity of ebsting sanitary utility lines buried along Bracketts Creek. Materials were moved around on the site using loaders. All temporary stream impacts were minimal and site conditions were restored to current or an improved state after the project conclusion. Comments: There is only 234 total linear feet of stream impact. Temporary and permanent impacts occur on the same stretch of stream. S1 - Permanent impacts were associated with installing the backfill and rip -rap below OHW to restore the creek bank to pre -flood conditions. Temporary impacts were associated with access to the project site. Placement of non -erodible material was used to keep flow away from the site to establish a dry bank work area to install the backfill and rip rap. Minimal rip rap was placed in the stream bed. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:* This project involved both temporary and permanent impacts of the bank along Bracketts Creek in the Town of Forest City. However, these impacts were minimal and the outcome of this project was meant to provide an emergency fix to avoid possible failure of vulnerable sanitary utility lines in a severely degraded streambank that resulted from recent flooding conditions in late April, early May. The design implemented was meant to temporarily reduce erosion and increase bank stability to maintain the integrity of the utility lines. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:* Construction of the proposed design was accomplished by grading back the bank to create a bench on which equipment was able to operate and materials were able to be moved. Excavation of subgrade for the installation of the rip rap was consecutive and continuous. Disturbed areas of the streambank were stabilized immediately following grading work. Permanent seeding followed construction work. Throughout the duration of the project, all excavated material was stored in upland stockpiles with appropriate erosion prevention BMPs. These activities were completed to minimize in -stream work and prevent environmental damage from a sanitary utility line failure. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Data on endangered species was obtained from the US FWS website for Rutherford County, North Carolina (https://ecos.fws.gov/ecp0/reports/species-by-current-range-county?fips=37161) and the NatureServe Explorer Species Reports (http://e)plorer.natureserve.org/index.htm). The list of endangered species potentially present in Rutherford County was reviewed. Project site conditions were found not to be conducive habitat to support several of the listed endangered species or threatened species that may live in Rutherford County. However, there is one species, the white irisette, that has the potential to live around the project site because most populations now live in artificially disturbed areas. The existing utility maintenance corridor may be conducive habitat for this species, but it is unlikely that this species was impacted by the bank stabilization work undertaken by the Town of Forest City. Designated critical habitat was reviewed via the US FWS mapping application (https://fws.maps.arcgis.com/home/mbmap/vievver.html?webmap=9d8de5e265ad4fe09893cf75b8dbfb77) and the project site was not within one of these designated habitats. Northern long-eared bat habitat in the western part of the state was checked (https://www.fvG.gov/asheville/htmls/project—review/NLEB—in—WNC .html). Although some confirmed hibernation and maternity sites for the Northern long-eared bat are present in Rutherford County, none of these mapped sites were in the project site. 6.
