The Division of Water Quality has reviewed your submittal fora 401 Water Quality Certification for the
aforementioned project. A site visit conducted on May 26, 2009 raised questions that need to be addressed in
order for us to make an informed permit decision. These issues are not mentioned in your application, and are as
follows:
1. Please explain why the entire 452 linear feet of shoreline need rip-rap stabilization. Approximately 90
feet of the shoreline is already armored with a concrete bulkhead.
2. The field visit by our staff confirmed that severe erosion issues do exist along parts of the shoreline of
this property. However, portions of the waterfront appear quite stable and well vegetated, particularly on
the northern end of the property. Please explain the need for armoring in these locations.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we are placing your permit application on hold until we are
supplied the necessary information. You have 21 days to respond in writing with the requested information or
notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not
received this information in writing, we will assume you are withdrawing your application and it will be

copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
