On behalf of the applicant, Mr. David Hughes, the Assistant Town Manager, please find attached a complete
application and supplemental information requesting written concurrence from the U.S. Army Corps of Engineers
(USACE) and the N. C. Division of Water Resources (NCDWR) that the activities proposed below may proceed under
Nationwide Permit 12 and Water Quality Certification 4133. In addition, the applicant would like to request a Jordan
Lake Watershed No Practical Alternatives Determination from the NCDWR for the proposed impacts to riparian

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions of the project area consist of an existing 30' Town of Apex Sanitary Sewer Easement
within the Apex Nature Park and then forested throughout the proposed easement connecting to two existing sleeves that
were constructed under Highway 540 for utilities. The general land use in the vicinity of the project is residential.
3b. List the total estimated acreage of all existing wetlands on the property:
Approximately 8.37 acres of wetlands as shown on the Overall Stream and Wetland Cover sheets.

3d. Explain the purpose of the proposed project:
The purpose of the proposed project is to construct 10,262 linear feet of sanitary sewer from the Apex Nature Park to two
sleeves that have been constructed under Highway 540.
3e Describe the overall project in detail, including the type of equipment to be used.-
The
sed:The overall project consists of the construction of 10, 262 linear feet of sanitary sewer. A section of the new sanitary
sewer will be constructed within a portion of an existing 30' wide Town of Apex Sanitary Sewer Easement (non -forested),
with an additional 15' wide easement added (forested). This section starts at a doghouse manhole within the park
property to approximately SSMH111 (i.e. manhole 111). The easement sections from SSMH 111 to SSMH 113, and then
from SSMH 119 — 144, SSMH 200-205 are completely proposed. And finally, the easement section from SSMH 113 —
119 is an existing 30' wide Town of Apex Sanitary Sewer Easement, but with no current sewer. All of the proposed and
existing without sewer are forested. There will be a total of seventeen (17) wetland impact areas and six (6) stream
impact areas throughout the project. Typical equipment used for excavation and construction will be utilized for this
project.

D. Impact Justification and Mitigation
Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S&EC completed a wetland & stream delineation for the entire existing and proposed easement in order to identify natural
resources so that impacts could be avoided & minimized to the maximum extent practicable. The new sanitary sewer is
being constructed within the existing utility 30' wide Town of Apex Sanitary Sewer Easement to the maximum extent
practicable. The new 15' sewer easement widening on the west side of Evans Road was flipped from the north to the
south side of the existing easement from the doghouse manhole to SSMH 107 to avoid stream impacts. The remainder of
the proposed sanitary sewer was designed to avoid/minimize impacts to wetlands, streams and Zone 1 of the riparian
buffer to the maximum extent practicable. Note that from SSMH 113 - 119 there were the constraints of an existing 30'
Town of Apex Sanitary Sewer Easement, and the proposed sections were obtained easements from adjacent landowners.
The town required riprap to be keyed into the stream at crossings for future maintenance access, the riprap has been
designed to only be constructed within % of the maintained easement. Compensatory mitigation is being proposed at the
perennial stream crossings that require riprap. Construction methods such as directional drill or Bore & Jack were not
proposed because they were cost prohibitive, considering the length of the sanitary sewer to be constructed. Wetland
mitigation is being proposed at a 1:1 mitigation ratio to exhibit additional minimization. All permanent, no permanent loss
and temporary wetland impacts will be brought back to pre -construction contours and re -vegetated with a wetland seed
mix post -construction. All temporary stream impacts will be brought back to pre -construction elevations and stream banks
will be stabilized.

As per the project engineer, the project will utilize standard E&S measures required by the Town of Apex, including
measures such as silt fence, silt fence outlets, tree protection fence, temporary interlocking composite mats at wetlands
and at stream crossings measures such as pump arounds or coffer dams will be utilized and determined by the
construction contractor.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that other publically funded projects mayor may not result in cumulative impacts. The Beaver Creek Sewer
Outfall project is within a developed watershed. Please note that this project is located within the Town of Apex
jurisdiction, therefore any adjacent properties that have potential for development will have the following regulations
to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program includes
permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction
stormwater management requirements; 2) Jordan Lake Watershed Riparian Buffer Protection regulations, these
regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a
minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved;
and 3) the Water Supply, Watershed Protection Program which limits development densities as well as requires
protective riparian buffers. We anticipate that the NCDWR will advise us if any additional information is needed.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.
