I wanted to let you know that I have reviewed the first 2 items on my request for additional information. Thank you for
supplying the supplemental information. Please note that if the plans for the culvert change in the future and riprap is
to be placed below the culvert, this would be considered additional stream impact and a permit modification will be
required. As this is an Individual Permit application and future modifications for additional impacts may be required to
be placed on another public notice, it's my opinion that you will want to be certain about that before we issue the
404/401. In my experience, it is common for DEMLR to require a riprap apron at the outlet of a culvert that long for
velocity control.
We will let you know once the stormwater review has been completed, and as I noted below in an earlier email, please
submit a copy of your response to the USACE to me when it is completed.

The letter I sent out had 3 items in it that needed to be addressed. In addition, although I neglected to state it in my
letter, and I apologize for that omission, we need to be copied on your response to the USACE since their public notice
serves as our public notice and we include the response to the public comments in our file prior to issuing the 401. So,
even when you've addressed all the items in the attached letter, and our stormwater review is complete, we will wait to
issue the 401 until we receive a copy of the response to the USACE. Please feel free to call or email back if you have
further questions.

Following up on a voicemail I just left you, I spoke with Karen Higgins earlier today to check on the status of the review
and she suggested that I speak with you. She said that she thought there is additional information you're waiting on in
order to have a complete application and are waiting to start the review until that is received. We have received some
additional comments from and through USACE but nothing else from your office besides the letter asking us to submit
for a state Stormwater permit. Can you let me know if anything else is needed? I just want to make sure this keeps
moving, if anything else is needed I'll work to provide it immediately.
