(3) No attempt will be made by the permittee to prevent the full and free use by the publiciof all navigable waters at or adjacent to the authorized work. (4) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. (5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. b. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. c. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. d. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this -2- permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. Project summary Applicant proposes to construct a deck on an existing pier and place mooring pilings into Taylors Creek at pronerty located at j ?i 1607 Front Street, Beaufort, Carteret County i 9. Narrative description The,applicant's property is 3/4 acre tract located at 1607 Front Street adjacent to Taylors Creek in the Town of Beaufort, Carteret County. The property is divided by Front Street in two segments, the applicant's residents being on the inland parcel and the pier (the site of this proposed project) is on the waterward parcel. The waterward parcel is, low, approximately 2-3' in elevation,and is currently kept mowed as a yard area. The shoreline is bordered by a 5-15' wide fringe of smooth cordgrass marsh. Located at the site, is a pier of unknown age. The applicant is proposing the construct "wings" on either side of the existing pier in order to form a deck about 200 sq:ft. in size. Immediately offshore of this pier (approximately 2011 the appii- can proposes to place two mooring pilings approximately 24' apart. The finished structure is proposed to moor a sailboat. 10. Anticipated impacts Conducting the project as proposed will involve the consumtion of another 750 sq.ft. of public trust area by creation of the proposed boat slip area. Project summary Applicant proposes to construct a deck on an existing ,_pier and place mooring pilings into Taylors Creek at property located at 1607 Front Street, Beaufort, Carteret Countv 9. Narrative description The applicant's property is 3/4 acre:tractlocated at 1607'Front Street adjacent to Taylors Creek in the'Town of Beaufort, Carteret County. The property is divided by Front Street in two segments, the applicant's residents being on the inland parcel and the pier (the site of this proposed project) is on the waterward parcel. • o The waterward parcel .is low, approximately 2-3' in elevation,and is currently kept mowed as a yard area. The shoreline is bordered by a 5-15' wide fringe of smooth cordgrass marsh. Located at the site is a pier of unknown age. The applicant is proposing the construct "wings" on•either side of the existing pier in order to form a deck about 200 sq.ft. in size. Immediately offshore of this pier (approximately 20') the appli- can proposes to place two mooring pilings approximately 24' apart. The finished structure is proposed to moor a sail boat. 10. Anticipated impacts Conducting the project as proposed will involve the consumtion of another 750 sq.ft. of public trust area by creation of the proposed boat slip area.
