Mercer and plan view dated 6/16/86 This permit, issued on 9/24/R6 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The proposed dock addition, as indicated by plat dated 6/16/86, is hereby deleted. (2) The bulkhead alignment will'approximate the MHW shoreline, and, at the time of construction, follow the general configuration as depicted on the work plat drawings. (3) All backfill material will be obtained from an upland source and properly stabilized in such a manner as to prevent any runoff and erosion of the earthen material into the adjacent waterway. (4) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (5) The activity will be conducted in such a manner as to prevent significant (See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Walker - Broad Creek Carteret County The applicant proposes to bulkhead approximately 210' of manmade canal. A pier 180' parallel to the bulkhead is also part of the project. The project is located on a canal that is adjacent to the mouth of Broad Creek, classified SA and open to shellfishing. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project requires 401 certification, but should meet the general certification for bulkhead construction. 2. As stated by the applicant the additional dockage area should not be used for the mooring of boats. This area should not be allowed to dock more than 10 boats as this is not an appropriate area for a marina. This office has no objections to this project provided the above conditions are met. Project summary The applicant proposes to construct a bulkhead 210' 1'ong on a man=made canal off Bogue Sound; a 180' .pier will prallel the bulkhead. II 9. Narrative description The project site is located at the end of a private dirt road leading in from SR 1122 which is known as.the Broad Creek Loop Road off Hwy. 24. This 1.6 acre tract of land fronts on the eastern shore of Broad Creek near the entrance to Bogue Sound. A lengthy man-made canal averaging 20-30' wide borders the pro- perty on the east side. This total area is known as the Broad Creek Community in Carteret County just west of Morehead City. The property is characterized by a large, two-story house with a domestic type yard which is well vegetated and stabilized with an existing bulkhead that extends from the Broad Creek side of the property up into the man-made canal. A highground boat house, boat ramp, and boat basin further characterize the exist- ing facilities. The specific project site involves a 200' sec- tion-of shoreline that borders the man-made canal just north of the applicant's boat basin. Years ago, when the canal was ori- ginally excavated, the spoils were cast on the applicant's pro- perty and other properties along the west side of the canal. As a result, the project shoreline exhibits residual patches of salt marsh cordgrass, black needlerush, patens and Distichilis. It has been established that approximately 100 sq.ft. of tidally influenced wetlands will be displaced by the proposed. project. In addition, about 1500 sq.ft. of non-tidal and elevated patens will be displaced on the highground property. The applicant proposes to construct a bulkhead on the canal shore- line and build a dock that will parallel the proposed bulkhead. The alignment of the 210' long bulkhead will start in the boat basin and proceed up the canal for a distance of 1801. The pre- viously mentioned tidal marsh occupies the turning corner in the proposed bulkhead alignment. Generally, the proposed bulkhead will be installed an average of 2' waterward of the existing bank and near the boat basin the alignment may be offset as much as 51. The proposed pier will not extend more than 3' into the canal. In March of 1986, Mr. Walker was cautioned to stop work onthis project and advised to file application for state and federal per- mits to complete the project as proposed. At that time, most of the pier and bulkhead support piling's were installed. Also, about 40' of the decking to the proposed pier had been nailed down. Dur- ing the course of our onsite visit in June, four boats were ob- served tied to the area of the proposed pier and support piles along the canal. 10. Anticipated impacts I The proposed bulkhead and backfill will directly displace about 1 100 sq.ft. of coastal wetlands vegetation and about 210 sq.ft. of I ' i canal bottomland below the MHW shoreline. These losses cannot be con- sidered significant to the local marine resources or the-ecology of the area. The new facility could provide additional boat dockage and possibly increase traffic on the canal that %Tzji?p lead to the erosion of the salt marsh•cordgrass on the opposite/of the 20-30' wide canal. There is also a possibility that boats moored to the proposed pier could impede public navigation in the waterway of the canal. However, the applicant in his cover letter to this office clearly states that he has no intentions of using the additional dockage area to moor boats. He goes on to say that he is not a marina and that only six boats will ever frequent the property during the summer months. 1 r i t v James L. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will not be positioned farther waterward than an average of 2 feet from the existing canal bank. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. No attempt will be.made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. -2- e. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. f. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. g. This permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and it does not authorize any injury to property or invasion of rights, or any infringement of Federal, State or local laws or.regulations. Narrative description The project site is located at tha end of a private dirt road leading in from SR 1122 which is known as.the Broad Creek Loop Road off Hwy. 24. This 1.6 acre tract of land fronts on the eastern shore of Broad Creek near the entrance to Bogue Sound. A lengthy man-made canal averaging 20-30' wide borders the pro- perty on the east side. This total area is known as the Broad Creek Community in Carteret County just west of Morehead City. The property is characterized by a large, two-story house with a domestic type yard which is well vegetated and stabilized with an existing bulkhead that extends from the Broad Creek side of the property up into the man-made canal. A highground boat house, boat ramp, and boat basin further characterize the exist- ing facilities. The specific project site involves a 200' sec- tion of shoreline that borders the man-made canal just north of the applicant's boat basin. Years ago, when the canal was ori- ginally excavated, the spoils were cast on the applicant's pro-' perty and other properties along the west side of the canal. As a result, the project shoreline exhibits residual patches of salt marsh cordgrass, black needlerush, patens a-nd Distichilis. It has been established that approximately 100 sq.ft. of tidally influenced wetlands will be displaced by the proposed.project. In addition, about 1500 sq.ft.. of non-tidal and elevated patens will be displaced on thehighground property. The applicant proposes to construct a bulkhead on the canal shore- line and build a dock that will parallel the proposed bulkhead. The alignment of the 210' long bulkhead will start in the boat basin and proceed up the canal for a distance of 180'. The pre- viously mentioned tidal marsh occupies the turning corner in the proposed bulkhead alignment. Generally, the proposed bulkhead will be installed an average of 2' waterward of the existing bank and near the boat basin the alignment may be offset as much as 51. The proposed pier will not extend more than 3' into the canal. In March of 1986, Mr. Walker was cautioned to stop work onthis project and advised to file application for state and federal per- mits to complete the project as proposed. At that time, most of the pier and bulkhead support piling's were installed. Also, about 40' of the decking to the proposed pier had been nailed down. Dur- ing the course of our onsite visit in June, four boats were ob- served tied to the area of the proposed pier and support piles along the canal. 10. Anticipated impacts ! The proposed bulkhead and backfill will directly displace about i 100 sq.ft. of coastal wetlands vegetation and about 210 sq.ft. of - It ?iC s canal bottomland below the MHW shoreline. These losses cannot be con- sidered significant to the local marine resources or the ecology of the area. The new facility could provide additional boat dockage and possibly increase traffic on the canal thatgd lead to the erosion of the salt marsh--cordgrass on the opposite/of the 20-30' wide canal. There is also a possibility that boats moored to the proposed pier could impede public navigation in the waterway of the canal. However, the applicant in his cover letter to this office clearly states that he has no intentions of using the additional dockage area to moor boats.
