Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The boat house structure will not extend into the central third of Ship Creek , which would be located 48' from the MHW level. (2) Perimeter walls of the boat house will be no more than one-half of the distance between the water and the lower side of the roof. (3) A 15' setback will be maintained between the applicant's boat house and the adjacent riparian property lines of the owner to the south. (4) No floor will be allowed in the structure except for perimeter catwalks of no more than 6' in width. (5) Under no circumstances will sandblasting or paint spraying be acconiplished over waters or wetlands. (6) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (See attached sheet for Additional Condition This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North _Carolina Coastal Management Program. A review of your application received February 20, 1986, for a Department of the Army permit to construct a covered boat shed on Pasture or Ship Creek off Broad Creek, Pamlico County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. Only after receiving such confirmation should you begin work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters on the United States. b. The permittee will maintain the boat shed in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. c. Narrative description The applicant's property is a 1-3/4 acre tract located adjacent to .Ship Creek off Fork Point. Road in Pamlico County. The property is approximately 5' in elevation at its maximum point, and is wooded ex-. cept for the areas composed of marsh and the building locations. The property has a marsh gut primarily composed of black needlerush.which • extends 230' into the center.of the parcel. -A 20' x 60' workshoP- ex- ists near the road and.a.24' x 40' office/shop is under construction at the landward end of the pier. The pier is an existing 4' wide wooden structure which is elevated over both wetlands and waters. The applicant operates a boat maintenance business and specializes in deck, cabin, and.rigging repairs and refinishing. His proposal' is related to this commercial activity and involves the construction ..of an open-sided boat house 20' ':aide by 260' 1 o g_ in Ship Creek at the waterward end of the existing pier. The boathouse will provide cover for vessels from the weather so people, surfaces, and finishes are protected during various maintenance processes. During operations dust and particle control will be accomplished by a .tarpolian apron which will be tied around the vessels as they are being serviced. Upon completion of servicing, the particles and waste materials will be removed from the apron and-from the deck of the boat prior to its re- moval. Ship Creek in this area is an average of 130' wide and the fartherest point of this structure will extend 60' into the water. Water depths in the project area are approximately 3 1/2' deep. 10. Anticipated impacts. Construction of the boathouse will involve the removal of about 1200 sq.ft. of public trust waters from the public trust area. Removal is not permanent; however_.it will be for a long term commercial, wa- ter dependent purpose. Carolina 28557 _-Dear sirs We propose to build a 60' long X 20" wide X 25' high covered shed along side our existing dock. The shed will be used to shelter boats while painting and varnishing super-structures of boats and doing interior work; all hull and bottom work will. be done in our enclosed work shed on landt'; .tinder no circumstances will sandblasting or paint spraying. be done over; the water oR marsh grass. We realize that paint chips and dust falling into the water is a problem, and propose to eliminate said problem by attaching a canvas skirt around the boat and tying it out around the piles supporting the shed. This procedure will trap paint chips and dust which can then be removed with a vacuum cleaner. The boat shed will-be constructed from a workboat and in no way will the surrounding marsh grass be disturbed. While talking to Mr. Bill Moore, we were informed that storm water runoff is becoming a concern; we plan to build a gutter system.on the office/ shop at the end of the dock and run the rain water 50'. away from the marsh. Narrative description The,applicant's property is a 1-3/4 acre tract located adjacent to Ship Creek off Fork Point Road in Pamlico County. The property is approximately 5' in elevation at its maximum point, and is wooded ex- cept for the areas composed of marsh and the building locations. The property has a marsh gut primarily composed of black needlerush which extends 230" into.the.center of the parcel. A 20' x.60' workshop ex- ists near the road and a 24' x 40' office/shop is under construction at the landward end of the pier. The pier is an existing 4' wide .wooden structure which is elevated over both wetlands and waters. The applicant operates a boat maintenance business and specializes in deck, cabin,.and rigging repairs and refinishing. His proposal is related to this commercial activity.and involves the construction of an open-sided boat house 20' wide by 260' long in Ship Creek at the waterward end of the existing pier. The boathouse will provide cover for vessels from the weather so people, surfaces,-and finishes are protected during various maintenance processes. During operations dust and particle control will be accomplished by a tarpolian apron which will be tied around the-vessels as they are being serviced. Upon completion of servicing, the particles and waste materials will be removed from the apron and from the deck-of.the-boat prior.to its re- moval. Ship Creek in this area is an average of 130' wide and the farther_est point of this structure will extend 60' into the water. Water depths in the project area are approximately 3 1/2' deep. 10. Anticipated impacts Construction of the boathouse will involve the removal of about 1200 sq.ft. of public trust waters from the public trust area. Removal -is- not permanent; however, it will be for along term commercial, wa- ter dependent purpose.
