A pond existed on the property prior to its development as a single family residence. The pond was later drained by the landowner. Fill material was deposited on property and within the pond bottom before the landowner was made aware that this required a permit from the USACE and DWR. The landowner has worked with the County, DWR and USACE to resolve the issue, and is proposing here to restore the stream and wetlands. A stream was presumed to have ebsted within the drainage prior to the construction of the pond many years ago. A stream was not discernible on the aerial photos and the owner had a perimeter ditch cut around the fill area. As such, we were unable to identify a stream on the epsting conditions map. However, the stream restoration project proposed to restore 520 linear feet of stream channel through the previously drained pond bottom. 4. As such, it could be stated that the project will result in a loss of 0.315 acres of open water. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. As such impacts to the drained pond area could not be avoided to accomplish this goal. Efforts where made to restore a greater amount of wetlands and free flowing stream then epsted within the drain pond to restore it to as close to the "pre -pond", natural conditions as possible. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:* An erosion and sediment control plan was obtained for the project from Chatham County to protect downstream waters during construction of the restoration project. 2.
